Za pozemkové knihy se považují knihy, do kterých se zaznamenávaly zápisy týkající se majetkoprávních změn především zakoupených poddanských usedlostí. Od 80. let 18. století postupně zachycovaly jakékoliv nemovitosti a změny v jejich majetkoprávním držení, což nabylo úplné platnosti vydáním zákona o pozemkových knihách z roku 1871. Byly vedeny nejprve v kancelářích majitele panství (popřípadě městskými nebo obecními úřady) a po roce 1850 u okresních soudů. Předmětem pozemkových knih byly nemovité věci a případně také s nimi neoddělitelně spojená živnostenská práva (např. právo vařit pivo, provozovat mlýn, kovárnu nebo řeznictví). Pro zcizení, zatížení nebo rozdělení nemovitosti byl vyžadován souhlas vrchnosti. Poddanská nemovitost mohla být zatížena zástavním právem nebo výměnkem a jinými věcnými břemeny aktivní nebo pasivní povahy. Při jejím užívání musel poddaný respektovat také rychtáře (ve Smiřicích primase) nebo sousedská práva. S poddanskou nemovitostí byla spojena povinnost řádného hospodaření, zákaz jejího opuštění nebo zadlužení nad stanovenou hranici. Při porušení těchto povinností byl poddaný stíhán sankcí spočívající v nuceném prodeji nebo zabrání statku. Legal Status of Serfs at the Smirice Estate in the Light of Land Books in the Period 1590 - 1848 Abstrakt Land Books are the books, where the propriety changes primarily concerning purchased serfs' homesteads have been recorded. Since the 80s of the18th century it has been recorded in the Land Books, item-by-item, any realty and changes in its propriety keeping. The factual situation was given its validity by passing the Act on Land Books in 1871. The Land Books were firstly kept at offices of the manor's owner (or as the case may be, by city or municipal office) and by county courts after 1850. The subject-matter of the Land Books were the immovables and the trade rights inseparably connected with them (e.g. the right to brew beer, to run a mill, a smithy or a butcher's shop). A permission from the manorial lords was necessary to alien, burden or divide a realty. A surf's realty could be burdened with a pledge or stipulated rights of a former holder of the homestead and other encumbrances both active or passive in nature. While using them a surf was obliged to respect a head of village (the magistrate in Smirice) or the neighbor rights.
