[cze][eng] 1. Shrnutí Většina států se opírá při úpravě svého soukromého práva o zásadu pacta sunt servanda. V rámci právní jistoty smluvních stran tedy většina právních systémů vyžaduje, aby smluvní strany splnily to, na čem se ve smlouvě dohodly. Záměrem mé práce bylo zjistit, zda, a pokud ano jak, je možné se od dodržování tohoto principu odchýlit a vyvolat změnu či zánik závazkového vztahu. Ze zkoumání, které jsem provedla v rámci této diplomové práce, vyplývá, že zásada, že smlouvy mají být dodržovány, není neprolomitelná a smlouvy nejsou nezrušitelné. Naopak, mohou nastat situace, které povedou ke střetu výše uvedené zásady se zásadou rebus sic stantibus a která podle mého názoru nabývá v posledních letech na významu. Nejčastějším způsobem změny či ukončení závazkového vztahu je shodnou vůlí stran, která pramení z další základní zásady soukromého práva, a to autonomie vůle smluvních stran. Dalším příkladem může být přijetí nové právní úpravy v dané oblasti, která může mít dopad na výši plnění ze smlouvy; nelze také nezmínit "moderační právo" soudu, které je také s to ovlivnit rozsah plnění. Další možností, tedy změnou či zánikem závazkového vztahu v důsledku podstatných změn poměrů, se zabývala tato práce. Summary The Influence of a Change of Circumstances on the Existence of an Obligation The purpose of my thesis is to present a brief outline of the problems concerning the impact of the change of circumstances on the existence of an obligation. The leading principle looking into this issue is the rebus sic stantibus principle. This principle can be considered as the opposite of the contemporary major contract rule worshipped by most of the European states and thus legal systems, the pacta sunt servanda principle. This principle, meaning the necessity of putting emphasis on the performance, is at present the fundamental principle of contract law of the Czech republic too. However, day-to-day life creates situations, in which the strict compliance with this principle can be in conradiction with justice and the contractor's expectations of the fairness of the law. The rebus sic stantibus principle is presently applied usually only to rare specific cases, the question, whether it should be allowed to terminate the contract under a essential change of the circumstances to all contracts in general, is an object of long-term discussions among many legal experts and legislators.
