Zabezpečovací detence představuje nový druh ochranného opatření, který se stal součástí nejprve novely trestního zákona (zák.č. 140/1961 Sb.) a posléze v širším pojetí i jeho rekodifikace, s účinností od 1.1.2009, resp. 2010. Zabezpečovací detence je v novém trestním zákoníku formulována jako ochranné opatření, jehož zavedení mělo za cíl vyřešit naléhavý společenský problém s výkonem ústavní ochranné léčby některých zvláště nebezpečných pacientů v psychiatrických léčebnách. Tato práce obsahuje dvě části. První část, týkající se zabezpečovací detence, představuje analýzu příslušných ustanovení trestního zákoníku a souvisejících platných právní předpisů a dostupných literárních pramenů. Druhá část práce je zaměřena na úpravu obdobného institutu v Anglii a Walesu. Jejím obsahem je představení tohoto nástroje, jeho právní zakotvení, analýza a problémy, se kterými se potýká. Při studiu problému jsem čerpala z publikovaných právních i lékařských písemných pramenů, oslovila jsem i tehdejšího primáře detenčního ústavu v Brně, MUDr. Petra Stožického, aby mi poskytl kvalifikované informace o praktickém fungovaní prvního českého detenčního ústavu, neboť dostupné názory, polemiky a komentáře se v roce 2010 pohybovaly víceméně v teoretické rovině. Security detention represents a new type of protective measure, which became part of the first amendment to the Criminal Code and then in the broader sense of its recodification, with effect from 1.1.2009, respectively 2010. Security detention aimed to deal with a pressing social problem regarding the treatment of certain particularly dangerous patiens in psychiatric hospitals. While studying the problem I contacted the then chief of the detention Institute in Brno, MD. Petr Stožický who provided me with qualified information on the practical operation of the first detention institute within the Czech Republic. The available laws, comments and controversy in 2010 ranged broadly at a theoretical level. The study contains the legislation of a similar programme in England and Wales.
