Tato práce pojednává nejen o velmi zajímavé, ale z hlediska výčtu všech ostatních skutkových podstat trestných činů také o skutkové podstatě poněkud vyčnívající. Tato, cum grano salis, kontroverznost trestného činu opilství, jakožto možného způsobu řešení postihu pachatele v době činu nepříčetného, je dána celou řadou vzájemně provázaných faktorů. Za výchozí lze přitom označit jednak nejednoznačnost panující co do názoru na samotné pojetí tohoto trestného činu, především pak ale jeho rozporuplnost i s tak pro trestní právo určující zásadou jakou je zásada odpovědnosti za zavinění. O těchto, jakož i o dalších s tímto trestným činem nepochybně souvisejících otázkách, ať už z hlediska historického, současného nebo z hlediska de lege ferenda, se tato práce pokouší podat výklad co možná nejúplnější. This work deals with not only very interesting but also from the point of listing all other facts of the cases stated in the special part of the penal code also quite a protruding fact of the state. This, cum grano salis, contoversy of the criminal offence called alcoholism as a possible way of solution of the recourse at the time of the commitment of the criminal offence by a person of unsounded mind is created by many interconnected factors. As the starting point could be taken the ambiguity which predominates in the view of conception connceted with this criminal offence, first of all its contradictoriness even with such a determining principle as the principle of liability for fault is. This work is trying to give explanations of these and other questions undoubtedly connected with this criminal offence , whether from the historical, contemporary or de lege ferenda point of view.
