- RESUMÉ Potřeba bydlení patří bezesporu k základním lidským potřebám každého jedince. Ne každý je ovšem vlastníkem domu nebo bytu. K řešení takové situace, kdy nedisponujete vlastním bydlením, slouží institut nájmu bytu. Zde se ovšem střetávají zájmy dvou skupin osob, pronajímatelů a nájemců, které z logiky věci reprezentují zájmy zcela odlišné. I z tohoto důvody státy do nájemních vztahů aktivně zasahují tak, aby zajistily právo na bydlení nájemcům a zároveň ochránily vlastnická práva pronajímatelů. Řada státu dospěla ke způsobu bytové politiky, který vychází z přesvědčení, že nájemce je slabší stranou nájemního vztahu. Tímto způsobem je právní regulace nájmu a nájemného. Má diplomová práce nazvaná "Právní úprava regulace nájmu bytu - regulované nájemné" si klade za cíl především popsat vývoj v této oblasti v České republice za posledních 20 let, připomenout, že regulace nájmu rozhodně není fenoménem jen této dekády. Práce se zaměřila především na regulaci nájemného, jak také vyplývá z jejího názvu, neboť tato se stala stěžejním tématem řady debat a pokusila se popsat deregulační snahy v českém právním řádu za poslední období, včetně dosaženého výsledku, který v době jejího zadání nebyl ještě znám. Lze konstatovat, že regulací dochází k omezení vlastnického práva pronajímatelů. Odpovídali taková... - RESUMÉ The need for housing is undoubtedly one of the basic human needs of each individual. Not everyone, however, is the owner of the house or the apartment. To address this situation, when do not have their own housing, serves the institute of the tenancy. Here, however, the two interests conflict groups clash, landlords and tenants, who represent completely different interests. This is one of the reasons for states to actively intervene to the tenancy to ensure the right to housing for the tenants and also to protect property rights of the landlords. Many states came to the way of the housing policy, which is based on the belief that the tenant is the weaker party to the lease. In this way, this is a legal regulation of the rent and the lease. My thesis, entitled "The legislation regulating tenancy - a regulated rent" aims primarily to describe developments in this area in the Czech Republic in the last 20 years, noted that the regulation of the rent is definitely not just a phenomenon of this decade.
