[cze][eng] Cílem práce je zaměřit se na platnou právní úpravu v České republice, zejména zákon č. 72/1994 Sb. o vlastnictví bytů a analyzovat práva a povinnosti členů společenství vlastníků jednotek. Důvodem zaměření práce na vlastnictví bytů a bytovou politiku je, že je jednou z nejdůležitějších oblastí, která se týká široké veřejnosti. Práci tvoří tři kapitoly, přičemž každá z nich se dotýká vlastnictví bytů. První kapitola podává informace o historickém kontextu residenčního bydlení a je úvodem do vlastnictví bytů obecně. Práce informuje o současné právní úpravě a současně reflektuje ustanovení nového občanského zákoníku účinného od 1.1. 2014. Další kapitola představuje společenství vlastníků jednotek a definuje základní terminologii. Předkládá právní úpravu týkající se bytového společenství ve smyslu subjektu práva a objasňuje právní regulaci společné správy domu. Včetně vnitřní struktury společenství a popisuje relevantní otázky týkající se společenství vlastníků jednotek. Poslední kapitola je stěžejní částí práce. Hlavním cílem je analýza jednotlivých práv a povinností vlastníků jednotek potažmo členů společenství vlastníků jednotek. Práce se zabývá problémy v souvislosti s členstvím a vlastnictvím jednotky. Dále práce poskytuje přehled relevantní judikatury českých soudů, která napomáhá lépe vykládat...Rights and duties of the member of Flat owners association The purpose of my thesis is to focus on applicable law in the Czech Republic, particularly the Flat Ownership Act 72/1994 Coll. and analyze the rights and duties of the members of Unit owners association. The reason for my research is that the flat ownership and housing is one of the most important sector which affects the general public. The thesis is composed of three chapters, each of them dealing with aspects of flat ownership. Chapter one informs about historical context of housing and tries to introduce the flat ownership in general. Thesis provides information about contemporary regulation and also about relevant provisions of new coming civil code which will be applicable by 1 January 2014. Next chapter is introductory to Flat owners association and defines basic terminology. It explains a legal framework regulating the legal entity of the association and regulation of common property management. Including the internal structure and describes some relevant issues in respect with Flat owners association. Last chapter is most significant part of the thesis.
