Shrnutí Tato práce popisuje jazykový výklad v kontextu interpretace práva, kterou vymezuje nejen jako disciplínu právní, ale současně jako disciplínu společenskou, z níž má pro účely jazykového výkladu význam zejména vymezení pojetí interpretace lingvistické, oproti interpretaci právní. V následující kapitole zařazuje autorka jazykový výklad mezi ostatní výkladové metody, a přestože přijímá Ústavním soudem potvrzený názor, že jazykový výklad představuje pouze prvotní přiblížení k textu, hledá argumenty, které by toto tvrzení vyvrátily. Jeden z takových možných argumentů nachází při relativizaci výčtu lingvistických disciplín užívaných při jazykovém výkladu a poukázáním na fakt, že pokud by byla mezi tyto disciplíny řazena i pragmatika, došlo by k posunu od dosud formálního vnímání jazykového výkladu, neboť by jazykový výklad obsahoval i prvky výkladu teleologického, jehož obsah tvoří smysl a kontext, podobně jako u pragmatiky. Ve čtvrté kapitole věnuje autorka pozornost právnímu jazyku, který popisuje nejen jako předmět jazykového výkladu, ale také jako nástroj zákonodárce, protože právě nerespektování základním pravidel, která by měl zákonodárce při tvorbě právních předpisů dodržovat, dle jejího názoru vzniká nezbytnost aplikace jazykového výkladu. This thesis describes linguistic interpretation in the context of interpretation of law, that is defined either as discipline of law, either as social discipline. In linguistic interpretation plays basic role linguistic interpretation. In the chapter that follows the chapter with description of the linguistic interpretation and its specifics in interpretation of law, the author puts linguistic interpretation among the other methods of interpretation. Although she admits the opinion of The Constitutional Court of the Czech Republic, that linguistic interpretation is only the first approach to the text, she looks for argumentation that disproves this opinion. She finds one of possible arguments, when she relativizes enumeration of linguistics disciplines, because of pragmatics. Pragmatics as a linguistic discipline is not in this enumeration. The author says, that the reason is, that pragmatics would change meaning and understanding of the linguistic interpretation, bescause of presence of context as a common factor in pragmatics and in the teleological interpretation. The fourth chapter describes legal language as an object of the linguistic interpretation and also as an instrument of lawmakers.
