[cze][eng] Dne 1. ledna 2008 vstoupil v účinnost zákon č. 182/2006 Sb., o úpadku a způsobu jeho řešení (insolvenční zákon), který tvoří současnou právní úpravu úpadku v České republice. Důvodem pro přijetí nové právní úpravy nebyla pouze zastaralost starého zákona, ale zároveň i nutnost přizpůsobit českou právní úpravu právu Evropské unie. Insolvenční zákon spolu s jeho prováděcími předpisy tak tvoří zcela nové zákonné úpravy řešení úpadku, který je založen na zcela nových principech, přepracovává staré způsoby řešení úpadku dlužníka a zároveň i zavádí nové moderní způsoby. Kromě tradičního způsobu řešení úpadku konkursem zavádí insolvenční zákon dva nové sanační způsoby řešení úpadku - reorganizaci a oddlužení - které jsou výhodnější pro dlužníka i věřitele. Reorganizace je určena pro dlužníky podnikatele, oddlužení pak pro dlužníky nepodnikající. Tato nová zákonná úprava má však také mnoho nedokonalostí, které ztěžují její praktickou aplikaci. V této práci se tak snažím nejzásadnější problémy vybrat a blíže je přiblížit. Toto je tedy i hlavním účelem této práce - upozornit na největší problémy aplikace insolvenčního zákona a navrhnout jejich možné řešení. Toto téma jsem si vybral především kvůli své dvouleté praxi v kanceláři insolvenčního správce, když jsem tak s praktickými problémy insolvenčního řízení velmi...Selected problems of application of the Insolvency Act On the 1st of January 2008, Act No. 182/2006 Coll. on Insolvency and its Resolution (Insolvency Act), which constitutes the substance of current legal regulation of bankruptcy law in the Czech Republic, came into force. There was a need to adopt new regulation emerged not only as a result of obsolescence of the original regulation, which - despite numerous direct or indirect amendments - was not able to respond adequately to economic changes, but also due to the necessity to adjust bankruptcy law to European legal regulations. The Insolvency Act together with implementing regulations form the basis of an entirely new and complex legal regulation which stands on its own principles, introduces uniform insolvency proceedings for all kinds of resolutions of insolvency and also new forms of insolvency resolutions. In addition to bankruptcy as a traditional and liquidating form of insolvency resolution, the Insolvency Act introduces a reorganisation and a discharge of debts as preservation methods of insolvency resolution which might be more profitable both for the debtor and his creditors. Reorganisation is designated for entrepreneurs, while discharge of debts was adopted as a resolution of state of insolvency of non-entrepreneurs. But this current legal...
