Tato práce se zabývá ochranou rodiny z pohledu lidských práv a z pohledu Evropského soudu pro lidská práva a jeho judikatury. Zabývá se otázkou, jak jsou v České republice chráněna, vykládána a uplatňována práva na rodinný život. Práce vychází z ustálené judikatury Evropského soudu a jeho dvou rozsudků, které byly vydány v neprospěch České republiky za porušení čl. 8 Úmluvy o lidských právech a základních svobod, který zaručuje každému člověku respektování rodinného života. Česká republika je za porušování práv dětí často kritizována z toho důvodu, že nerespektuje právo dítěte na rodinný život, zasahuje do něj příliš necitlivě a zbytečně. Důsledkem toho pak je situace, kdy je v České republice poměrně více dětí v ústavních zařízeních než jinde v Evropě. K demonstrování situace v ČR jsou v práci uvedeny tři příklady rodin, kde došlo k omezení rodičovských práv a umístění dětí do ústavních zařízení. Klíčová slova: rodina, lidská práva, Evropský soud pro lidská práva, ochrana dětí, Úmluva o lidských právech a základních svobodách : This bachelor's thesis undertakes the protection of a family through the perspective of human rights and the perspective of the European Court of Human rights and its judicature. It deals with the question of how are the rights for a family protected, explained and administered in the Czech Republic. The thesis is based on accomplished judicature of the European Court and its two decisions against the Czech Republic for the violation of Art. 8 of the European Convention on Human Rights, which guarantees everybody the right for their family life to be respected. The Czech republic is often being criticized for violation of children's rights, mostly because it doesn't respect the right of children for a family and interferes with it too needlessly or insensitively. That results in relatively high numbers of children held in asylums in the Czech republic compared to other European countries. In order to demonstrate the situation in the Czech republic, in the text are introduced three examples of families' rights being restrained by moving the children into asylums Key words: family, human rights, European Court of Human rights, children protection, European Convention on Human Rights
