[cze][eng] Diplomová práce se zabývá právními vztahy založenými smlouvou o sdružení, kterou uzavírají nájemníci bytového domu za účelem koupě jimi užívané nemovitosti. Účelem práce je poukázat na právní důsledky vyplývající z užití smlouvy o sdružení při privatizaci bytového fondu. Sdružení založené smlouvou dle ustanovení § 829 a n. obč. zák., není subjektem práv a povinností. Jedná se o smlouvu, jíž se účastníci dohodnou, že budou vzájemně koordinovat svou činnost za účelem dosažení sjednaného účelu - koupě bytového domu. Práce obsahuje podrobný popis historického vývoje předmětného právního institutu, od jeho římskoprávních kořenů až po současnou právní úpravu. Obecná část dále obsahuje vymezení pojmových znaků smlouvy o sdružení, pojednává o vzniku a zániku členství, zabývá se problematikou jednání členů vůči třetím osobám, vymezuje práva a povinnosti pojící se s členstvím ve sdružení a zabývá se dalšími aspekty smlouvy o sdružení dle platné právní úpravy. Ve stručnosti práce poukazuje na důvody a možné formy privatizace bytového fondu. V této souvislosti je rovněž upozorněno na rozdílnosti mezi prodejem bytových jednotek a prodejem bytového domu. Jelikož je smlouva o sdružení, jehož účelem je koupě a následná správy nemovitosti, uzavírána větším počtem účastníků a jelikož se přímo dotýká uspokojování bytových...The thesis deals with the legal relationships based on association, which is made by the housing tenants in order to purchase the real estate used by them. The purpose of the work is to inform about the legal consequences arising from the use of the contract of association at the privatization of flats or block of flats. Association founded by an agreement under the provision of § 829 and next of the Civil Code, is not a legal person. It is a contract in which the parties agree that they will coordinate their activities in order to achieve the agreed purpose - the purchase of housing. The work contains a detailed description of the historical development of this institute, since its roman law roots to the current legislation. The general section also contains the definition of the notion of characteristics of the association agreement, discusses the creation and termination of a membership, it deals with the conduct of members in respect of third persons, defines the rights and obligations tied to a membership in an association and deals with other aspects of the association agreement according to the legislation in force.
