[cze][eng] Tato disertační práce se zabývá mezinárodní ochranou investic. Jejím cílem je pomocí analýzy dostupné národní a mezinárodní judikatury odpovědět na otázku, jakým způsobem se predominantně v soudobném mezinárodním právu určuje státní příslušnost "investora" a jaký je vliv této okolnosti na investice v situacích řetězení vlastnických vztahů subjektů jsoucích státními příslušníky různých států; jinými slovy, tato disertační práce se zabývá ochranou investic holdingových struktur, struktur vlastních jak nadnárodním společnostem tak dnes i menším investorům. Cílem této práce dále je v tomto kontextu odpovědět na otázku, jakou roli hraje či nehraje institut corporate veil na efektivnost ochrany subjektů jsoucích součástí těchto struktur. Práce je dělena do několika kapitol, pro něž je charakteristická jak definiční interakce, tak relevantní samostatnost disketových okruhů. První kapitola má za úkol úvod do problematiky ochrany investic, jakož i historický přehled a diskuzi vývoje mezinárodního práva, od obecné ochrany investic v režimu diplomatické ochrany tak, jak byla definována v roce 1759 E. de Vattelem,1 až po současné partikulární režimy dvou- a vícestranných smluv o ochraně investic (BITs a MITs). Tato kapitola dále diskutuje rozdíly mezi těmito režimy, jakož i postavení fyzické a právnické osoby...The current thesis focuses its attention on the arena of international investment protection. Using available case-law, it aims at answering the question as to in what way the nationality of an investor is being determined under international law - in particular in arbitration. Moreover, it aims at determining the impact a chaining of investors from different states into a holding structure potentially has on the arbiters' view when determining an investor's (or an investment's) nationality. The objective of this thesis is to determine to what extend the institution of corporate veil influences the nationality of persons participating on above described holding structures, in terms of how these are viewed in international arbitration and to what extend piercing a corporate veil exists in the arbitral case law. The dissertation is divided into several chapters which, although relatively independent interrelate in the covered subject matter with one another as follows: The first chapter's objective is to introduce the reader into the arena of investment protection and to provide him/her with a historic overview and discussion of international law.
