ZÁVĚR SHRNUTÍ Ve své diplomové práci jsem se věnoval problematice porušení procesních předpisů při dokazování a neúčinnosti důkazů. První část práce se zaobírá dokazováním obecně, jeho zákonnou úpravou a právní teorií, která se k němu vztahuje. Další část práce se týká současného stavu úpravy přípustnosti, zákonnosti a účinnosti důkazů obecně, tedy vysvětluje tyto pojmy a jejich vzájemný vztah. Těžiště práce spatřuji v části poslední, která popisuje možné procesní vady vybraných důkazních prostředků - výslechu obvitého, výslechu svědka, tzv. detektoru lži, znaleckého posudku a odposlechu a záznamu telekomunikačního provozu - jak z hlediska zákonné úpravy, tak i po stránce judikatury soudů. DOPORUČENÍ Dokazování je bezesporu stěžejním okamžikem celého trestního řízení, na němž záleží kvalita soudních rozhodnutí. Současná úprava správně konstatuje, že za důkaz může sloužit vše, co může přispět k objasnění věci, nicméně dokazování musí podle mého názoru splňovat požadavky nejen na kvantitu, ale i na kvalitu. Zatímco kvantita dokazování je ošetřena výše zmiňovaným ustanovením, úprava a záruky kvality dokazování jsou podle mého názoru nedostatečné. Platná právní úprava se omezuje na obecný zákaz nezákonného donucení a zákaz hrozby takovým donucením, což považuji za nedostatečné. Jak lze pozorovat na vlastním... RESUME The purpose of my thesis is to analyse criminal law regulation of rules of evidence and its consequences regarding nullity of evidence. The reason for my research is my long term interest in criminal law and specifically criminal proceedings The thesis is divided in two basic broad chapters and subsequent sub-chapters. The first chapter deals with general aspects of rules of evidence, explaining basic terminology and basic principles that dominate the law of evidence, division of evidence and general rules on admissibility of evidence as covered by the only explicit condition which is provided by the Criminal code of proceedings (that is that evidence shall not be acquired by compulsion or by threat of thereof) and by contemporary legal theory. The second chapter deals with particular forms of evidence such as examination of the defendant, examination of witnesses, expert evidence, polygraph and monitoring of telecommunication and the rules that govern them. Each of the forms of evidence is described with emphasis on potential errors in proceeding that may result in nullity of the evidence.
