Název práce: Řízení o přestupcích v prvním stupni. Tato práce pojednává o přestupkovém řízení v prvním stupni, konkrétně se zabývá postupem správního orgánu před zahájením řízení. Vychází z nejnovější literatury, zapracovává novou judikaturu, přihlíží i k metodikám Ministerstva vnitra a problémům praxe. V kapitole I. se definuje přestupkové řízení, vymezuje se jeho vztah ke správnímu řádu, definuje se pojem přestupku a rozebírá se možnost užití analogie. Ve II. kapitole je uveden popis hlavních procesních zásad přestupkového řízení a jejich význam pro řízení. Kromě zásad vyplývajících přímo z přestupkového zákona jsou popsány i zásady ústavní a správní. Ve III. kapitole se práce zabývá příslušností správních orgánu v přestupkovém řízení, a to příslušností věcnou, funkční a místní. Zabývá se i změnami těchto příslušností. Dále v této souvislosti práce pojednává o zvláštní odborné způsobilosti úředních osob a o uzavírání veřejnoprávních smluv. V poslední části se řeší důvody pro vylučování úředních osob, především z důvodu podjatosti. Ve IV. kapitole se vysvětluje účel postupu před zahájením přestupkového řízení. Nejprve se popisuje přijímání podnětů k zahájení řízení správním orgánem. Dále se obšírně zabývá součinností mezi jednotlivými orgány, především jejich povinností oznamovat přestupky. Zvlášť... Title of this thesis: Proceedings for administrative infractions in the first instance The thesis deals with administrative infraction proceedings in the first instance, specifically about the steps of administrative office before instituting the administrative proceedings. It is based on the new scholarly literature, incorporates new judicature and takes account of methodologies of Ministry of the Interior and practical problems. In the chapter I there are defined administrative infraction proceedings, its relation to Administrative proceedings Act and the infraction and there is also described the possibility of using analogy. In the chapter II there is description of the main procedural principles of administrative infraction proceedings and their importance to proceedings. In addition to the principles resulted directly from Misdemeanours Act there are also described the constitutional and administrative principles. In the chapter III there is described competence of administrative office in administrative infraction proceedings, namely subject-matter jurisdiction, local jurisdiction and function competence. It deals with the changes of these competences too. Furthermore, in this context the thesis deals with professional competence of persons in authority and with contracts under public law....
