Cílem této práce bylo ukázat vývoj právní regulace vztahu člověka k lesům a myslivosti a zároveň vzájemnou provázanost lesního a honebního práva. V nejstarších dobách bylo bohatství lesů a zvěře nedotčené. Během počátku osídlování naší země nebyl lov nijak omezen ani regulován. Od 11. století šlechta vlastnící dědičné lesy omezila právo lovu zvěře. Za vlády Karla IV. byly podniknuty první kroky k ochraně lesů v podobě právního předpisu nazvaného Kodex Carolinus, který nebyl pro odpor šlechty přijat. V 15. a 16. století si lidé začínají uvědomovat hodnotu lesa a bohatství z něho pocházející. Mnoho právních předpisů vztahujících se k ochraně lesů pocházelo právě z této doby. Do 18. století byly lesy v kritickém stavu. Největšího rozvoje zaznamenalo lesní právo za vlády Marie Terezie a Josefa II. Za nejvýznamnější právní regulaci té doby považujeme lesní řád z roku 1754. Z hlediska vývoje lesního a honebního práva bylo průlomovým vydání patentu č. 54/1849 ř. z. císaře Františka Josefa I. z roku 1849. Panovník jím zrušil právo šlechty lovit v držbách ostatních lidí. V 19. století se koncepce lovu pomalu začíná posouvat od zaměření na kvantitu ke kvalitě. V roce 1852 byl vydán císařský patent č. 250/1852 ř. z. Jednalo se o první právní regulaci, která zakotvila v oblasti lesnictví moderní právní... This thesis depicts the evolution of the relation of people to our forests and hunting till the year 1938. During the initial settlement of our country all members of tribes were free to hunt without regulations. Since the 11th century the wealthy aristocracy had their own hereditary woods and restricted the right of hunting animals. The first important step to protect our forests was taken by Charles IV but his legal regulation called Codex Carolinus wasn't approved because of the aristocracy opposition. The profitability of forestry began to be appreciated in the 15th and the 16th century. Many instructions regulating the protection of forests were issued in this period. The forests were in an alarming state, exhausted and without wood reserves till the 18th century. The forest law underwent the biggest development under the rule of Maria Terezia and Joseph II. The most important legal regulation in that period was the hunting rule from the year 1754. The biggest break in the development of hunting law was brought by the patent No. 54/1849 i. a. of the emperor Frank Joseph I. in 1849. The monarch cancelled the nobility's right of hunting in other people's holdings by means of this patent.
