Univerzita Karlova, Právnická fakulta, Katedra práva životního prost edí Praha, zá í 2010 Cílem práce je konfrontovat stávající právní a institucionální rámec ochrany biodiverzity s biologickými principy a nejzávažn jšími p í inami jejího ohrožení, a p itom zhodnotit, do jaké míry jsou tyto systémy a jevy v souladu, p ípadn kde existují mezery i nedostatky. Jako metoda této konfrontace je zvolen p ehled a rozbor relevantních pramen práva a dalších souvisejících informací v kontextu jednak jednotlivých úrovní biodiverzity, dále pak v kontextu n kterých vybraných v cných a právních souvislostí. S ohledem na charakter biodiverzity, která podobn jako další složky životního prost edí p íliš nerespektuje lov kem um le vytvo ené hranice, je klí ové mezinárodní právo celosv tového, p ípadn regionálního významu. V p ípad mo ského prost edí, které je do zna né míry homogenní z hlediska svých fyzikálních i ekologických vlastností to platí tém bezvýhradn . V prost edí pevninském lze fragmentaci fyzikálními a geografickými podmínkami pozorovat, pokud jde o právní režim, tak do hry mnohem výrazn ji vstupují jednotlivé státy, a to jednak svými vlastními normami, ale i zp sobem,... Charles University, Faculty of Law, Department of Environemntal Law Prague, September 2010 The aim of the dissertation is to confront legal and institutional framework of conservation of biodiversity with its biological principles and most serious current threats, and assess to which extend are these systems and phenomenons in conformity and where eventually exist gaps and shortages. As a method of this confrontation was chosen an overview and analysis of relevant sources of law and other related information in the context of each level of biodiversity, and further in the context of several substantive and legal connections. With respect to characteristics of biodiversity which, similarly as other components of environment, does not respect borders created artificially by man, international law of global and regional scope plays a crucial role. It is valid almost without any reservation for nearly homogenous marine environment, in case of terrestrial environment some physical and geographical framgmentation can be observed and the role of particular state with its internal legal regime is more important.
