[cze][eng] Závěr Environmentálním, sociálním a ekonomickým výzvám současného světa nelze dle mého názoru čelit bez aktivního zapojení a podpory širokého spektra společnosti, včetně jednotlivých občanů a nevládních občanských sdružení. Důvody pro zapojení veřejnosti jsou poměrně pragmatické: vlády mohou prosazovat ochranu životního prostředí mnohem účinněji, pokud k tomu budou mít podporu veřejnosti, čehož lze dosáhnout i tím, že veřejnost bude informovaná, zapojená do procesů rozhodování a její zájmy budou brány v potaz; informovaná veřejnost může na druhé straně také napomoci nápravě nesprávných rozhodnutí orgánů veřejné správy. Neopomenutelnou součástí zapojení veřejnosti do procesu ochrany životního prostředí je umožnit jí přístup k přezkumným řízením v případech, kdy dochází k porušení právních předpisů na ochranu životního prostředí. Přístup k právní ochraně v záležitostech životního prostředí je zásadním prvkem implementace environmentální politiky a prosazování zákonů na ochranu životního prostředí, protože bez možnosti efektivního vynucení by právo životního prostředí bylo jen "bezzubým" nástrojem. Významným krokem k posílení práva na přístup k právní ochraně v záležitostech životního prostředí na poli mezinárodního práva bylo přijetí Aarhuské úmluvy. Státy, které k Úmluvě přistoupí, musí zajistit veřejnosti...- Access to Justice in Environmental Matters Access to justice in environmental matters is a relatively new environmental law institute which enables the members of public to contest administrative acts and omissions of both administrative authorities and individuals in front of an independent and impartial authority. A break through international law document which addressed the issue of access to justice in environmental matters was the so-called Aarhus Convention adopted in 1998. The Aarhus Convention is a binding environmental treaty that requires its signatories to grant citizens in their respective countries access to environmental information, participation in decision-making in environmental matters and judicial redress where the two previous rights or other environmental law have been violated. The idea behind the Convention is that involving citizens in protecting the environment will improve environmental protection as they often have a keen interest and decisions in the environmental field directly affect their quality of life. By now the Convention has been ratified by 44 parties, including the EU. Therefore, the obligation of the Czech Republic to ensure that its national legislation provides citizens the right to challenge acts in breach of environmental law in courts arises not only...
