Rigorozní práce "Zásada kontradiktornosti v řízení před soudem a její budoucnost v českém trestním procesu" se zabývá především tím, do jaké míry se v současném českém trestním řízení projevuje zásada kontradiktornosti a v jakém rozsahu je ve stávajícím trestním procesu vůbec možné další rozšiřování projevů této zásady. Práce se hlásí ke snaze nalézt příčiny, proč česká soudní praxe odmítá přijmout a používat některé charakteristické kontradiktorní projevy v řízení v podobě zvýšení aktivity a procesní odpovědnosti stran trestního řízení přesto, že se je zákonodárce pokusil do zákonného textu výslovně zavést. Tyto příčiny jsou v práci hledány prostřednictvím zkoumáním historických souvislostí, výčtu ústavních a lidskoprávních východisek, analýzy úloh jednotlivých stran trestního řízení i soudu, a stručného exkursu do některých zahraničních právních úprav. Zhodnocena je též současná fáze přípravy rekodifikace českého trestního práva procesního a další perspektivy vývoje trestního procesu a rozvoje míry jeho kontradiktornosti. Rigorosum thesis "Principle of contradiction in court proceedings and its future in Czech criminal process" is focused mainly on the extent to which the current Czech criminal proceedings reflect the principle of contradiction and also to which the existing criminal process enables any further expansion of this principle's manifestation. The thesis is trying to find the reasons why the Czech judicial practice usually refuses to accept and use certain characteristic symptoms of contradictiory proceedings in the form of an increase in activities and the burdens of the responsible parties despite the fact that the legislator tried to introduce those symptoms into statutory text explicitly. This is researched in the thesis through examining the historical context, the enumeration of constitutional and human rights foundations, analyzing the roles of the parties in the criminal proceedings as well as the role of the court and a brief introduction into some of the foreign criminal procedures. The thesis also evaluates the current phase of preparation the new Czech criminal procedure law and its presumed level of contradiction.
