[cze][eng] 71 Závěr Prostředky ochrany osobnosti představují mechanismus, jehož snahou je zmírnit následky zásahů do osobnostního práva jednotlivce, v ideálním případě těmto zásahům zabránit. Nastíněny byly možnosti, které právo poskytuje prostřednictvím občanského zákoníku i zákonů zvláštních, aby byl zaručen rozvoj osobnosti jednotlivce. Význam a charakter osobnostního práva spolu se zakotvením na ústavní i mezinárodněprávní úrovni vyžaduje nahlížet na aspekty ochrany osobnosti optikou aplikační praxe Ústavního soudu i Evropského soudu pro lidská práva. Technologický vývoj nezbytně vede k pružnějšímu využití stávajících prostředků způsobem, díky němuž je možné zachovat ochranu před novými způsoby ohrožení osobnostního práva. Inspirací k tomu lze nalézt nejen v rozhodnutích Evropského soudu pro lidská práva, ale rovněž srovnáním funkčních institutů jiných právních řádů, v tomto případě práva anglického. Cílem je vytvoření uceleného a funkčního sytému prostředků, jež efektivně hájí osobnostní sféru jednotlivce.81 Legal instruments of personality protection of an individual in civil law Summary The thesis intends to present Czech legal instruments of protection of personality within the framework of current decisions of Czech courts and the European Court of Human Rights, compared to the selected English legal instruments of protection of personality. The thesis is divided into six chapters. Chapter One deals with the basis and importance of protection of personality. In the second chapter, legal guarantees of protection of personality on the international and national level are outlined. Chapter Three explains the concept of general right to personality and Chapter Four concerns with subjects of general right to personality. Chapter Five deals both general and specific legal instruments of protection of personality regulated by civil code and other statutes, particularly injunctions (interim, permanent) and satisfaction (moral, financial compensation of non-pecuniary loss). The last part of the work concerns with selected aspects of current information technology development and its influence upon the personality rights of an individual and ways of their protection.
