Diplomová práce obsahuje historický přehled vzniku a vývoje institutu ochrany práv třetích osob v exekučním řízení. V této části je kladen důraz na dobu Římské říše a pak je sledován vývoj od 19. století do dnešní doby. Stěžejní část práce se zaměřuje na popis současného stavu exekučního řízení ve smyslu zákona č. 120/2001 Sb., o soudních exekutorech a exekuční činnosti, jeho postavení v právním řádu ČR, základní zásady tohoto řízení a to vše ve vztahu k ochraně práv třetích osob v exekučním řízení. Rozděluje třetí osoby na jednotlivé skupiny a popisuje jejich práva a povinnosti vyplývající z právní úpravy. Soustřeďuje se na popis prostředků ochrany a obrany. V závěru poskytuje přehled nejdůležitějších novel exekučního práva ve vztahu k tématu. The thesis contains a historical overview of the origin and development institute of protection of the rights of third parties in enforcement proceedings. In this section, the focus is on the period of the Roman Empire and then follows the development from the 19th century untiltoday. The fundamental part of the work focuses on the description of the current state of enforcement proceedings under the Act no. 120/2001 Coll. The Executors and Execution, his status in the legal order of the Czech Republic, the basic principles of management and everything in relation to the protection of the rights of third parties in enforcement proceedings. Distributes third party to various groups and describes their rights and obligations under the legislation. It focuses on the means of protection and defense. In conclusion provides an overview of the most important novels enforceable rights in relation.
