Tématem této práce je rozvod a jeho majetkové vypořádání - komparace české a německé právní úpravy. Práce je rozčleněna do čtyř základních kapitol, ve kterých je postupně vyložena historie právní úpravy rozvodu, dále je popsán pojem rozvodu jako takový, poté následuje výklad o rozdílných majetkových režimech u nás a v Německu a nakonec se věnuje majetkovému vyrovnání manželů po rozvodu. Práce využívá jak analytickou metodu, tak metodu komparativní. Každá kapitola je pro přehlednost rozčleněna do podkapitol, kde je nejprve pojednáno o české právní úpravě, následně o německé právní úpravě a na závěr jsou obě právní úpravy srovnány. Cílem této práce je obě právní úpravy porovnat a zjistit shodné a odlišné znaky. První kapitola se věnuje historii rozvodu. Výklad začíná obdobím středověku a chronologicky postupuje přes právní vývoj v 18. a 19. století až k 20. století. V druhé kapitole je popisován pojem rozvodu. Nejprve je vyloženo, jak obecně manželství zaniká v obou právních úpravách, dále je věnována pozornost kvalifikovanému rozvratu, jako jedinému rozvodovému důvodu. Na závěr této kapitoly dochází k rozdělení a odlišení základní úpravy rozvodu od rozvodu se zjišťováním příčin rozvratu a rozvodu s užitím proti-tvrdostní klauzule. Ve třetí kapitole se výklad prostřednictvím manželských majetkových... The topic of the thesis is divorce and its consequences on property - comparison of Czech and German legal regulation. The thesis is divided into four basic chapters, in which there is described the history of divorce, then there is explained the term of divorce itself followed by definition of different matrimonial property regimes in the Czech republic and in Germany. In the end the thesis concerns settlement of property between spouses after the divorce. The thesis profits from both analytical and comparative methods of approach. Each chapter is divided into subchapters for better clarity and easier orientation. The subchapter consists of first explonation of Czech legal regulation, followed by German legal point of view and both of them are compared at the end of each section. The aim of this thesis is to explore similarities and differences between both legal regulations. First chapter deals with the history of divorce. The periods concerned are medieval times, the 18th and 19th Century and the whole 20th Century's development in the end. The second chapter is dedicated to the term divorce itself. First the termination of marriage in general is explained, then the thesis pays attention to a qualified breakdown as the only possible legal reason of divorce. At the end of this same chapter the...
