Abstract: In the following paper we try to explain some of the legal rules concerning cases of defective implementation of public lighting. Public Lighting Construction Agreements concluded after 1st January 2014 are governed entirely by new Civil Code, including the rights of defective performance. The new regulation is based largely on the adjustment of the cancelled Commercial Code, so we focus only on significant changes and innovations in these matters introduced with effect from 1st January 2014 by the new Civil Code.
