Práce se zaměřuje na základní pravidla pro uplatňování nároku na odpočet daně z přidané hodnoty. Tato pravidla vymezuje z pohledu tuzemského zákona o DPH a legislativy Evropské unie, která je v oblasti daně z přidané hodnoty představována Směrnicí Rady 2006/112/EHS. Při prosazování a interpretaci evropského práva pak hraje hlavní roli Evropský soudní dvůr a jeho judikáty. Cílem této práce je vyhodnotit pravidla pro uplatňování nároku na odpočet daně z přidané hodnoty a zjistit, do jaké míry je český zákon o DPH ve věcné shodě s právními normami Evropské unie. Dále zjistit, čím se liší a jaké to má dopady na plátce DPH. This work focuses on the basic rules for exercise of the right of deduction VAT. These rules are defined out from point of domestic law on VAT and European Union legislation, which is in the field of value added tax represented by Council Directice 2006/112/EC. In promotion and interpretation of European law plays a mojar role European Court of Justice. The aim of this work is evaluation rules for exercise of the right of deduction VAT, identifying how the Czech law differs from the European Union legislation and what it has impact on VAT payers.
