Financial Proposal for Thermal Insulation of an Apartment Building

Thesis "FINANCIAL PROPOSAL FOR THERMAL INSULATION OF AN APARTMENT BUILDING" deals with possibilities of financing the reconstruction of panel house, analysis of offers in Czech market and optimal proposal for financing such kind of reconstruction. Theoretical part contains following kinds of financing possibilities: home loan, mortgage, no-purpose credit and not bank loan. Practical part of thesis compares offers from Czech banks. In last part of thesis I propose the optimal financial plan for this reconstruction on base of requirements of supplier of reconstruction and banks conditions.
Accounting specifics of Unit Owners Associations

The aim of the Bachelor's thesis is an accounting area analysis of Unit Owners Association with subsequent errors elimination and recommendation for their elimination. The thesis deals with the legal regulation of the XY Unit Owners Association and provides information on the accounting procedures and tax specifics of this legal entity according to Czech accounting legislation and regulations. The main objective of the theoretical part is to define the activites of the Unit Owners Association and the House and Land Administration. It also describes its formation, dissolution and activites of individual bodies. The thesis also focuses on the transfer from Housing Association to Unit Owners Association. The knowledge of the XY Unit Owners Association from the theorical part is applied in the practical part. Their statutes define formation, XY Unit Owners Association bodies and the rights and obligations of individual owners. The accounting documents work as a basis to show the accounting procedures, methods and tax aspects during the accounting period. The end of this thesis lists the imperfections in the accounting of XY Unit Owners Association.
Comparison of housing cooperatives and owners' associations from the accounting and tax point of view

The thesis provides information on accounting procedures and tax obligations of a community of unit owners and a housing association according to Czech legislation. The main objective is to define and compare accounting and tax aspects of a community of unit owners and a housing association from a theoretical and practical point of view. In the practical part, theoretical knowledge is applied to a community of unit owners ABC units a housing association XYZ. According to their statutes, the formation of the given unit, their authorities, obligations, and rights of owners of units (members of the community), the management of the unit is defined. Then, on a basis of accounting documents, procedures, methods of accounting and taxation for individual entities are displayed. Following an analysis of legal, accounting and tax aspects of the ABC community of unit owners and the XYZ housing association, main differences between these subjects are described. Closing part of this paper is focused on recovery of debts from a community or association members, charging of advances on services, house management and value added tax with recommendations from experts.
Association of housing unit owners

The bachelor thesis deals with analysis of the regulation of special legal entity - The associations of housing unit owners. It is an independent private law institute which is legally regulated in Act No. 89/2012 Coll., The Civil Code. There are described basic principles how associations works. One of the main aims of this paper is to compare between old and new law regulation of this institute. It is been mistakenly confused for a co-operative housing by general public. For this reason there is a chapter focused on co-operative housing to clear the differences between these two institutes. In addition there are described basic concepts and brief historical law development of the association of housing unit owners. It also includes questionnaire survey and guided interview. The questionnaire survey has been done with fifteen association members in total fifteen associations. The aim was find out the way members look at association, their view of statutory body and find out how well they know their internal regulations. Same number of surveys has been done with statutory body. Lastly, three guided interviews with assosiation members has been done for more detailed approach of association of housing unit owners and how it works.
Activities of the Managing Board of an Apartment Owners Association

The diploma thesis deals with the condominiums where apartment owners association is established. The first part of the diploma thesis summarizes basic terms essential for understanding the topic. Subsequently the history of flats ownership in Czechoslovakia and later in the Czech Republic are explained. The first chapter of the analytical part focuses on the foundation of the apartment owners association, the course of the assembly of unit owners and election of a chairman and committee. The last chapter analyses the housing law of selected European country, and its result is subsequently compared to Czech legislation. Lastly, we provide a suggestion for improvement of Czech legislation and answer the questions asked in the beginning. The hypotheses that were established at the beginning are confirmer or refuted and all the results are explained.
Comparison of the legal regulaltion of residential cooperatives and unit owners' assotiations

This thesis deals with two legal forms of housing. These are residential cooperatives and unit owners' associations. The thesis deals with these two forms advisedly. The text will be divided into several parts - at first the historical process of both forms because it's routes influent the contemporary legal framework, the description and the analysis of both forms, the analysis of basic topics with implemented decisions of czech courts. The main method is the comparative method which is very proper and it shows points of views how to compare these two topics. The intention of the thesis is to analyse and compare the contemporary legal framework of residential cooperatives with unit owners' associations.
Thermal Insulation of Apartment Buildings: Decision-making Process and Effect on Energy Savings

Thermal Insulation of Apartment Buildings: Decision-making Process and Effect on Energy Savings Abstract In order to lower the emissions of green-house gases it is necessary to explore the wide range of the energy efficiency options. This thesis attempts to analyse the effect of thermal insulation installed in the multi-family apartment buildings during the period of 2006-2012 in the Czech Republic. We also investigate whether providing governmental funding further improves energy performance of the insulated apartment buildings. In addition, we examine the collective decision-making processes of members of the multi-family apartment building associations, including their attitudes towards thermal insulation of their houses. The basis of this thesis is the econometric panel data model (with 45 apartment buildings and their energy consumption before and after the insulation) evaluated by the fixed effects method with cluster confirming that the insulation, investments and public funding had all significant and negative impact on the energy consumption in the buildings, when energy consumption was adjusted for weather conditions. Ownership of flats and non-residential premises in relation with Act No. 72/1994 Sb.

I dedicated my thesis to the matters of flat ownership in Czech Republic. I chose the topic not only because it is my area of interest, but also because it is an acute problem, which impacts more than 1.5 million of Czech citizens. During the 17-year existence of the legislation and despite 13 amendments of the legislation, its application is often unclear. In my opinion, the legislation lacks sufficient regulations of the following: the establishment of a unit owners association, ensuring a proper management of unit owners association executive organs. In addition, some institutes have not been legislated but only regulated by secondary legislation - a Model Article - that however does not have to be adhered to by a unit owners association. In many cases, vague regulations or issues that have not been legislated, had to be resolved by judgment. First chapter provides an overview of the subject and the scope of the Flat Ownership Act (Act) and its concept and correlation with other acts, particularly the Civil Code. The second chapter discusses various types of establishment of flat ownership. The third chapter discusses various types of abolishment of flat ownership, including expropriation. The reason why I chose this topic for my master's degree thesis is its currency, which results from the recodification of the Czech civil law. The topic is also interesting and useful. I also live in two Flat Owners Associations (FOA), so it may have influenced my option. The aim of the thesis is to describe and explain the basic institutes of FOA. I put some emphasis on its bodies, while trying not to avoid the interpretative disputable areas. I will be grateful if this thesis helps some FOAs in their everyday problems. The thesis is divided into twelve chapters. After the introductory, theoretical and historical chapters, there follows the fourth chapter, which deals with the two fundamental terms - the administration of the house and the common parts of the realty. The fifth chapter describes FOA as an artificial legal person. It also deals with the founding and establishment of FOA. The next chapter focuses on the articles - the very important instrument for FOA's operation and management. The seventh chapter characterizes the rights and duties of the owners of the flats. - Governing Bodies of the Unit Owners' Association and Their Decision- Making The aim of my thesis is to analyze the system of governing bodies of the unit owners' association, their decision-making, powers and liability. The thesis also attempts to focus on and to clarify certain legal questions relating to the provisions of the Unit Ownership Act that cause problems of interpretation with the professional public, courts and unit owners. The thesis is composed of five chapters. Chapter One is introductory and outlines the legal framework of the topic and relevant Czech legislation, and sets out the aims of the thesis. Chapter Two examines the nature of the unit owners' association as a legal entity endowed with limited (special) legal personality that is formed by operation of law (ex lege). The association may exercise only such powers and only to the extent expressly permitted and set forth in the provisions of the Unit Ownership Act (No. 72/1992 Coll.) such as administration, operation, maintenance, repair, and replacement of common elements of the building.
