Municipalities and the Protection of the Environment The main aim of this Master's Degree thesis is to analyze mutual relations between two important branches of Czech law, the environmental law and the legal regulation of municipalities, which is the key part of a system of public administration in the Czech Republic and also a reliable measure of citizen participation in politics and the functioning of the state. There are two reasons why I have decided to choose this topic. The first one is that it is very close to me personally because of the region I come from, White Carpathians Protected Landscape Area where small municipalities play an important role in administering daily matters of public interest. The second reason is that I consider the subject very challenging due to the lack of existing sources and works, which are devoted to it. The diversity in environmental compartments and subsequent extent of the topic resulted in the necessity choose one group of closely related legislation. I have elected legal regulation of nature and landscape, forest and land protection. Private law instruments of environmental protection Abstract Private law deals primarily with the regulation of relations between individuals and the protection of their individual rights, whether personal or property. The aim of this dissertation is therefore to determine whether and how the instruments of private law can be used to protect the environment. For this purpose, an analysis of the relevant private law institutes has been carried out, such as the protection of the personality, neighbourhood law, and the prevention and compensation of damage, which are the most important means of protecting the rights of an individual. Protection of personality in private law is primarily designed to protect the life, health and privacy, but it is useful to indirectly protect the environment from the effects that these values threaten, as shown by extensive decision-making practice of the European Court of Human Rights. The right to live in a favourable environment is a new institute in Czech civil law, which could have a great potential for environmental protection purposes, but it still lacks a more detailed regulation and there is also no case law. Neighbourhood law serves to protect the real estate owners against the disruptive effects of the activities of their neighbours. These are referred to as imissions...

Analysis of legal instrument s of self-governments used in air protection

Air pollution from point sources is a serious problem that is mainly solved centrally and with use of public tools. The goal of this thesis is to find out whether in respect of the local and regional context of air pollution this problem can be solved by local self-governments and whether they may adopt the doctrine of free market environmentalism to protect the air with the use of private law as a subject of ownership. For this purpose, relevant instruments are analyzed, such as a nuisance action, an obligation of prevention and a liability for damages. The city of Ostrava even brought an action against the state, however, possibilities of its success are small. It was found that local self-governments could use these instruments to protect the air, but practical problems demotivate them.
