Legal Aspects of the Price Regulation in Electricity and Gas Sectors

Legal Aspects of Price Regulation in Electricity and Gas Sector The aim of the thesis is to provide a legal analysis of contemporary price regulation in electricity and gas sector in the Czech Republic. Under the current legal framework of Third Energy Package and the national pricing and energy legislation, the price regulation is most commonly used for natural monopolies which are in in electricity and gas sector represented by the operators of the transmission and distribution systems. From the material aspects, the regulated prices shall cover the economically justified costs to ensure safe and efficient performance of licensed activities, as well as depreciation and reasonable profit to ensure return on investments. From a formal point of view, the administrative acts of price regulation are, in accordance with contemporary case law, considered as normative administrative acts. Nevertheless, the thesis is also considering the other forms of administrative action for the performance of price regulation and the possible review of administrative acts of price regulation.
Legal status of neighbours in the procedures under the Building Act

The main aim of the thesis is to provide explanation of the legal status of the neighbours in the procedures under the Building Act while working with the contemporary literature and the established practice of the courts. The first part of the thesis is devoted to a description of basic concepts. The first chapter explains the concept of structure and plot. The second chapter is describing the concept of neighbour and the evolution of the concept in detail to provide the best means of understanding the possible problems of the concept's interpretations. The final chapter of the first part explores the means of neighbour's defence against interferences of his rights connected with his real estate with special attention to the essentials of objections, as these are the main mean of said defence, while the factual content of the objections is explained in later chapters within the boundaries of individual procedures. The second part is divided into four chapters each dedicated to a certain field of procedures under the Building Act while focusing the neighbour's point of view. Modulatory effect of monovalent ions on δ-opioid receptors

The exact role of opioid receptors in drug addiction and modulatory mechanism of action of monovalent cations on these receptors are still not fully understood. Our results support the view that the mechanism of addiction to morphine is primarily based on desensitization of μ- and δ-opioid receptors. Desenzitization of agonist response proceeds already at the level of G protein functional activity. Long-term exposure of rats to morphine resulted in increase of number of δ-opioid receptors and change of their sensitivity to sodium ions. Analysis of the effect of different monovalent ions on agonist binding in δ-OR- Gi1α (Cys351 -Ile351 )-HEK293 cell line confirmed the preferential sensitivity of δ-opioid receptor to sodium ions. We have distinguished the high- and low-affinity Na+ sites. Biophysical analysis of interaction of lithium, sodium, potassium and cesium ions with plasma membranes isolated from HEK293 cells with the help of fluorescent probes indicated that monovalent ions interact, in low-affinity manner, with the polar, membrane-water interface of membrane bilayer. Changes of membrane-bound and soluble proteins of frontal rat brain cortex induced by morphine

The aim of this Ph.D. thesis was to analyze the morphine-induced changes of frontal brain cortex protein composition in rats exposed to increasing doses of morphine (10-50 mg/kg) for prolonged period of time (10 days). The first part of this work was oriented to the analysis of the phenomenon of hypersensitization/superactivation of adenylyl cyclase (AC), which is regarded as one of the crucial molecular mechanisms causing drastic pathological consequences of drug addiction. The increase of AC activity represents a "compensatory" response and is functionally related to the desensitization of G protein response to prolonged morphine exposure of target cells. The clear desensitization of µ-OR- and δ-OR-stimulated G protein response by morphine was demonstrated in our laboratory by analysis of the dose-response curves of DAMGO and DADLE-stimulated, high-affinity [35 S] GTPγS binding in plasma membranes isolated from frontal brain cortex of rats exposed to morphine according to the same protocol as that used in my Ph.D. thesis (10-50 mg/kg, 10 days). The κ-OR-stimulated [35 S] GTPγS binding was unchanged. Marketing authorisation in the Czech Republic The purpose of the thesis is to provide an overview of essential principles of a process of medicinal products' marketing authorisation in the Czech Republic. Every medicinal product produced on a large-scale must be registered by responsible authority before launching on the market, this process guarantees its effectiveness and safety. Even though the topic is a subject of quickly evolving legislation, in the Czech Republic has not been elaborated any coherent monograph on the issue yet. The diploma thesis is composed of seven chapters, starting with the overview of the historical legislation of medicinal products' marketing authorisation and ending with today's legislation affected by European Union legislation. The second chapter is dealing with the history of the marketing authorisation of medicinal products, which has its beginnings in 1920s, such dating argues that this is not a new field of a legislation. Following a brief outline of the history the third chapter of the diploma thesis explains today's legislation and gives an overview of European legislation and jurisdiction of Court of Justice of the European Union that have important impact on the Czech legislation. Legal regulation of the port construction in the Czech Republic The purpose of the thesis "Legal regulation of the port construction in Czech Republic" is to describe the entire process of the construction work of the port in the Czech Republic. The master thesis defines in the first chapter some of the legal terms that are important for the successful implementation of the building project. The main objective of this chapter was to determine how the legal acts regard the legal term port. Thesis also defines the legal concept of waterwork. The definition of the waterwork is very important due to the fact that under the law the port is considerated as a water work. The next chapter deals with the urban planning proceedings and the individual stages of urban planning documentation. The thesis therefore describes in detail the various steps and requirements of urban planning documentation. The thesis also deals with the need to obtain the EIA for the assessment and also with the legal regulation of this document. The construction of port as the waterwork is strongly related to the building proceedings, which is in the area of ports construction replaced by the water acts proceeding. Price regulation of medical drugs in the Czech Republic

The purpose of the thesis is to complexly cover the area of pricing regulation of medicinal products in the Czech Republic. That means to analyze relevant Czech legislation and decision-making by the supreme judicial bodies in the country, investigate their historical background, compare conclusions already made in the area, and introduce own original suggestions. The reason for the research is an insufficient amount of sources covering the chosen topic, and in particular, the absolute absence of published papers which would embrace the topic of pricing regulation of medicinal products in the Czech Republic as whole. The thesis is composed of three chapters, each of them dealing with different aspects of the pricing regulation of medicinal products. Chapter One is introductory and defines basic terminology used in the thesis: price, pricing regulation, pricing decision, and medicinal product. Chapter Two examines the historical background of current legislation and possible approaches in the area of pricing regulation of medicinal products in the Czech Republic. Local referendum

Resumé The thesis examines local referendums, a form of direct democracy that is used the most in the Czech Republic. Nowadays, it is a standard part of municipal politics. The goal of the paper is to provide a complex analysis of the legislation, based primarily on relevant case- law, including the newest rendered in fall 2014. The thesis is composed of an introduction, nine chapters and a conclusion. The order of the paper largely follows the composition of the Act on Local Referendum. Chapter One examines the relevant constitutional and international legislation. Chapter Two describes the scope of topics that may be subjects of local referendums in general and also looks at the most frequent ones. Chapter Three concerns itself with the preparative committee - a body that puts forward the proposal to hold a local referendum - and examines its assembling and operation. Chapters Four and Five explores the review procedure of the committee's proposal conducted by municipal authorities and by municipal councils that render the final decision to hold a local referendum. Public-law regulation of advertising human preparations for medical treatment

This thesis deals with advertising of medicinal products for human use and its public law regulation contained especially in administrative law regulations. The thesis aims to bring information on the existing law in this area, explain particular legal institutes and propose potential amendments of the existing regulation in appropriate cases. The first chapter is devoted to definition of crucial terms of a medicinal product, advertising and public regulation, since their correct understanding is decisive for the following text. The second chapter concerns regulation of advertising, firstly in general and consequently concretely advertising of medicinal products for human use. The thesis is structured so that it concerns advertising focused on wide public separately from advertising focused on experts. The third chapter is devoted to responsibility, supervision, administrative proceedings and decisions in administrative judiciary, offences and sanctions in the area of regulation of advertising of medicinal products for human use. Occupancy of buildings and their alterations

This Diploma Thesis aims on providing a comprehensive overview of an issue re- garding the occupancy of buildings and alterations of the occupancy of buildings. Con- cerned piece of work is divided into eleven chapters in total further structured into sub- chapters. First chapter contains legal sources governing the issue of the occupancy of build- ings and alterations of the occupancy of buildings. The most important legislation con- cerning the issue is listed. This chapter fluently flows into the second chapter which ex- amines next-to-last amendment to the Building Act discussed frequently in the public. At the same time, this chapter establishes seven points to rationalize amendments to the legislation which are accepted positively by the author of this piece of work. Third chapter determines basic definitions contained in the Building Act used in the field of regulation of the occupancy of buildings and alterations of the occupancy of build- ings considered as fundamental for understanding of the concerned matter by the author.
