Právní aspekty cenové regulace v odvětví elektroenergetiky a plynárenství Rigorózní práce se zabývá výkonem cenové regulace v odvětví elektroenergetiky a plynárenství v České republice. Cenová regulace se v souladu s předpisy třetího energetického balíčku, zákona o cenách a energetického zákona, uplatňuje u provozovatelů energetických soustav, kteří reprezentují přirozený monopol. Z materiálního hlediska pokrývají regulované ceny v elektroenergetice a v plynárenství ekonomicky oprávněné náklady na zajištění bezpečného a efektivního výkonu licencované činnosti, dále odpisy a přiměřený zisk zajišťující návratnost investic. Z formálního pohledu jsou správní akty cenové regulace v souladu s ustálenou judikaturou považovány za normativní správní akty. Práce se věnuje i využití jiných forem správní činnosti pro výkon cenové regulace a možnostem přezkumu správních aktů cenové regulace. Legal Aspects of Price Regulation in Electricity and Gas Sector The aim of the thesis is to provide a legal analysis of contemporary price regulation in electricity and gas sector in the Czech Republic. Under the current legal framework of Third Energy Package and the national pricing and energy legislation, the price regulation is most commonly used for natural monopolies which are in in electricity and gas sector represented by the operators of the transmission and distribution systems. From the material aspects, the regulated prices shall cover the economically justified costs to ensure safe and efficient performance of licensed activities, as well as depreciation and reasonable profit to ensure return on investments. From a formal point of view, the administrative acts of price regulation are, in accordance with contemporary case law, considered as normative administrative acts. Nevertheless, the thesis is also considering the other forms of administrative action for the performance of price regulation and the possible review of administrative acts of price regulation.
