Poskytování zdravotních služeb začínajícími lékaři a s tím související občanskoprávní odpovědnost

Cílem článku je provést analýzu, jak český, německý a britský právní řád upravují problematiku vymezení kontroly a dohledu nad začínajícími lékaři, včetně s tím související občanskoprávní odpovědnosti za újmu na zdraví. Nejprve bude analyzován přístup zastávaný ve Velké Británii a v Německu. Se zřetelem k takto získaným poznatkům následuje rozbor problematiky odborného dozoru a dohledu nad začínajícími lékaři v českém právním řádu, včetně tematicky specifických otázek odpovědnosti za újmu na zdraví způsobenou porušením povinnosti poskytovat zdravotní služby na náležité odborné úrovni nejen ze strany začínajících lékařů, ale i lékařů je kontrolujících a rovněž samotných poskytovatelů. Součástí článku je rovněž exkurz do problematiky kvalifikace začínajících lékařů jako zkoušejících v medicínském výzkumu.

The reason why I chose this topic for my master's degree thesis is its currency, which results from the recodification of the Czech civil law. The topic is also interesting and useful. I also live in two Flat Owners Associations (FOA), so it may have influenced my option. The aim of the thesis is to describe and explain the basic institutes of FOA. I put some emphasis on its bodies, while trying not to avoid the interpretative disputable areas. I will be grateful if this thesis helps some FOAs in their everyday problems. The thesis is divided into twelve chapters. After the introductory, theoretical and historical chapters, there follows the fourth chapter, which deals with the two fundamental terms - the administration of the house and the common parts of the realty. The fifth chapter describes FOA as an artificial legal person. It also deals with the founding and establishment of FOA. The next chapter focuses on the articles - the very important instrument for FOA's operation and management. The seventh chapter characterizes the rights and duties of the owners of the flats. The bodies of FOA and the judicial intervention into its decision-making process are analyzed in chapters eight and nine. Obligation to compensate for personal injury in connection with provision of health care This dissertation is focused on the obligation to compensate for personal injury in connection with the provision of health care. The aim of the dissertation is to analyse relevant general elements of the obligation to compensate for personal injury as well as relevant special elements of such obligation. The dissertation surveys the interpretation of conceptual changes related to the recodification of Czech private law in the area of tort law in connection with the provision of health care. Legal basis of the doctor-patient relationship will also be analysed because such analysis is crucial for determination which elements of the obligation to compensate for personal injury will regularly be applied in this field. Therefore, the first chapter is devoted to the legal nature of the doctor-patient relationship.
