The Phenomenology of Social Fact

This thesis compares different theories of social fakts, from theories supposing thier ontological autonomy to the theory which makes them dependent on the sphere of psychological fakts. It compares them also with question of their relation to the human consciousness. The relation to the social fakts has the influence on the other phenomenons - the creation of mass, totality, social construction of reality, the principal of acausal synchronicity. It shows at the same time the danger and positives which conclude from it.

Poimenické aspekty komunikace na pomezí individuální eschatologie The poimenical aspects of communication at the interface with individual echatology Jiří Flam The present thesis responds to a question, whether there is a way of communication that can be used by churches to address the world, and that is not sufficiently used by the churches today. The thesis thus presents a specific means of communication, which is the law. The law is described as a communication process, and different methods how one can enter into such a communication process are presented. The success of a communication process depends on willingness of participants of such a process to communicate with each other. For this reason, the thesis also deals with the question, whether churches should seek the use of means of communication addressing the society as a whole, while the alternative might be the creation of closed theological elites. The answer to this question is sought through the Christological meaning of communication. The last part of the thesis focuses on research that would provide a partial answer to the question, whether the Czech society is actually interested in communication with churches, with special emphasis on communication concerning selected topics from the field of individual eschatology. The Psychological and Sociological Context of Theory of Law.

The aim of this thesis is to approach law from the perspective of some psychological and social phenomena and factors expressing our self­experience. When the psychological factor is changed, an adequate change of the law or its interpretation can be assumed. This can be considered as the evidence that the phenomena of law are linked to psychological and social phenomena. The question of self­experience is instantiated to the question whether law is affected by our individualistic or collectivist self­experience. This thesis operates with mental models that are conceived as ideal types, which are approached philosophically rather than historically. René Descartes' model of mind was chosen as a model of individualistic experience. As a model of self­experience or collective self­image, Carl Gustav Jung's model of a subject was selected and supplemented with considerations of Émile Durkheim, Emmanuel Lévinas, Edmund Husserl and Elias Canetti. The thesis assumes that psychic phenomena and their changes will be reflected in legal norms both in terms of their formation and in terms of enforcing their observance and in terms of their interpretation.
