New housing complex in Brno Komin is designed as sustainable, compact, high density quarter of low rising houses with park and newly composed garden allotment. In the discussion on the end of the bachelor thesis, author tries also to discuss some of the current standards, which influence directly the process of designing.

Protection of the Earth climate system from the legal point of view

Climate system protection from the legal point of view Climate change seems to be a defining ecological issue of the 21st century. However, unlike other global threats there are still some scientific uncertainties about the gravity of this problem and its actual consequences. On the other hand the proven fact is that the Earth climate is affected by altered atmospheric concentrations of greenhouse gases. Dozens of recent studies clearly indicate that the changes in the atmosphere are a result of human activities and that an immediate action is needed to reduce greenhouse gas emissions and avoid reaching more harmful levels. If nothing is happened, climate change would lead to a rise in global average temperature together with other associated impacts such as melting glaciers, rising sea-levels or more frequent appearence of extreme weather events. The climate change issue is being addressed both at international and national level. There is a need to take a coordinated action of all states worldwide with respect to their development capabilities and historic responsibilities. International negotiations in last couple of years have shown that it will be very difficult to achieve an agreement between countries with different intrests. The options available to the state in the awarding of contracts of strategic importance: Study 5.312

Práce se zabývá otázkou strategických zakázek a jejich zadávání v zadávacím řízení podle zákona o veřejných zakázkách. Vzhledem k tomu, že v českém právním řádu v současné době neexistuje zákonná definice strategických veřejných zakázek či zakázek strategického významu, považuje tato studie pro účely vlastního textu za strategické takové zakázky, kde předmětem plnění jsou dodávky, služby či stavební práce, které zajišťují bezpečnost, fungování a infrastrukturu země. Zvláštní důraz je pak kladen na zakázky na dodávky vojenského materiálu a na výstavbu jaderných elektráren. Důležitou součástí práce je podrobnější analýza platné právní úpravy, která se na předmětnou otázku vztahuje, a to jak na úrovni národní, které je věnována největší pozornost, tak i na úrovni evropské a mezinárodní. Účelem závěrečné kapitoly je posoudit z právního hlediska konkrétní možnosti a nástroje státu při přidělování zakázek strategického významu, tedy zejména v případech, kdy se stát snaží ochránit své základní politické a bezpečnostní zájmy.

Legal regulation of administrative delicts in selected European countries, with a focus on offenses against public order, civil co-existence and against property: Study 5.323

Práce se zabývá problematikou právní úpravy přestupků ve vybraných zemích Evropy, přičemž zvláštní důraz je věnován přestupkům v oblasti veřejného pořádku, občanského soužití a majetku. Práce se zaměřuje především na sankce udělované za tato protiprávní jednání a na postupy uplatňované, jestliže pachatel dobrovolně neplní uložené sankce. Mimo jiné se text zabývá také vymezením subjektů příslušných k projednávání takto spáchaných přestupků a postupů, které mohou být uplatněny, jestliže pachatel jedná při spáchání přestupku recidivně. Součástí této práce je také zodpovězení otázky, zda právní řády vybraných zemí umožňují postihovat dávky sociální povahy v případě nesplnění sankcí uložených za spáchaný přestupek.

Legal regulation of comparative advertising: Study 5.326

Práce přináší rozbor právní úpravy institutu srovnávací reklamy v České republice a na evropské úrovni. K přímému zakotvení institutu srovnávací reklamy, jakožto zvláštní skutkové podstaty nekalé soutěže, do českého práva došlo až v roce 2000, v důsledku toho bylo po celá devadesátá léta nakládáno se všemi případy srovnávací reklamy jako se zakázanými nekalosoutěžními praktikami. Téměř jakékoliv reklamní srovnání s konkurujícím subjektem, respektive s vlastnostmi jeho výrobku či služby, tak bylo před rokem 2000 soudy takřka automaticky shledáváno jako porušení dobrých mravů soutěže. Právě oblast klamavé a srovnávací reklamy je totiž předmětem regulace na úrovni Evropské unie a jednotlivá ustanovení tzv. harmonizačních směrnic EU se tak prostřednictvím transpozičních předpisů promítají do národního práva.
