Kosan, Jiří ; Handrlica, Jakub (advisor) ; Staša, Josef (referee)
Selected issues of the public regulation of export of dual use items Abstract At the time this paper was written, security was a dominant theme in the international environment. The military conflict in Ukraine, terrorism in Israel and the growing antagonism of global and regional powers have made topics such as military hardware, weapons of mass destruction and international sanctions very topical. Dual-use goods are closely linked to all these security issues. It can covertly significantly increase military capabilities in the field of conventional and unconventional weapons and in the field of information. Despite the fact that it is widely used in industry and can surround us at literally every turn, it remains in the shadows of wider attention. Yet its export carries with it a number of extensive obligations for the standard-setter. It defines dual-use goods as those products, software and 'know-how' that are usable for both civilian and military purposes. Their acquisition for the purpose of misuse is then referred to as 'proliferation'. The legal regulation of the export of such goods is specific because it is an interplay between international law and European law, which is applied by means of administrative law. By its very nature, it is complementary to international sanctions. Two categories of...

Korec, Jakub ; Staša, Josef (advisor) ; Sharp, Vladimír (referee)
1 Legal nature of technical regulations and technical standards Abstract This thesis deals with the question of the legal nature of technical regulations and technical standards. The position of both types of documents is quite different, because unlike technical standards, technical regulations are legal regulations. In particular, the legal nature of technical standards has changed over time. The aim of this thesis is to define both types of documents with regard to their nature in relation to law and the legal system, as well as to each other. The thesis is divided, if the introduction and conclusion are not counted, into seven chapters. The first chapter deals with the question of the development of legislation of technical regulations and technical standards. In both cases, past legislation was compared with current legislation. In the case of technical regulations, the issue of non-compliance of this definition with the definition of technical regulations in EU legislation and international treaties is addressed here, which resulted in the need to create a category of technical documents. This chapter also deals with the question of the classification of both types of documents within the legal system of the Czech Republic. The second chapter is devoted to the creation of technical regulations and...

Regional land use plan and its review Abstract The subject of this thesis is the regional land use plan, its legal aspects and its administrative and judicial review. Regional land use plan is issued by the regional council under its own authority (competence) and defines intended land usage of regional importance. The regional land use plan and its amendments take the legal form of a measure of general nature. The main objective of this thesis is to analyse the regional land use plan (which is covered by numerous regulations and statutes) in a comprehensive manner, to analyse its material and procedural aspects and to summarise its administrative and, especially, its judicial review. With regard to the upcoming recodification of construction law, the aim of this thesis is also to analyse the changes the new legislation will bring to these areas. The thesis consists of six main parts. The first part looks at measures of general nature and defines how they are different from other legal acts. I also look at relevant sections of the Administrative Procedure Code and summarize how it differs from...
