Tato práce se věnuje traktátu De alveo, který je dílem předního představitele středověké, italské školy komentátorů Bartola de Saxoferrato. Jeho text, který je jednou součástí jeho souhrnného pojednání o právních otázkách souvisejících se změnami říčního koryta, se zabývá opuštěným řečištěm. Obsah této práce tvoří analýza traktátu v kontextu právních pramenů své doby, kterými je podkládán, jako jsou Digesta, Codex, justiniánské Instituce, Novellae, Clementinae, Glossa ordina a dílo Azona, popřípadě v kontextu dalších děl jak Bartola de Saxoferrato, tak i dalších představitelů komentátorské školy, jako Baldus de Ubaldis, Iason de Mayno či Alessando Tartagni. Přestože se dílo nazývá traktát, tvoří ho komentář k Dig. 41.1.7.5- 6 (Gaius lib. 2 re. cott. sive aur.), který se věnuje jeho jednotlivým slovům či slovním spojením, čímž se často odchyluje od původního obsahu fragmentu z Digest. Zvláště v souvislosti, se slovem "incipit" a "amissa propria forma" se věnuje jiným, nesouvisejícím otázkám s přesahem do kategorií, které vychází z antické filosofie přejímanou středověkou filosofií. This paper is dealing with tractatus De alveo of the main representative of the medieval Italian school of commentators, Bartolus de Saxoferrato. His text, is part of the works dealing with legal questions connected with changes of a river bad called Tyberiadis, is about abandoned riverbed. Content of this work is comprised of an analysis of the tractatus in the context of legal sources mentioned in it, such as Digests, Code, Institutions of Iustinian, Novellae, Clamentinae, Glossa ordinaria and work of Azo, and work of other commentators like Baldus de Ubaldis, Iason de Mayno or Alessando Tartagni. Even thought, the name of Bartolus's work is tractatus, it is comprised of a commentary of Dig. 41.1.7.5-6 (Gaius lib. 2 re. cott. sive aur.), where the author is dealing with its words or their connections. Especially, words "incipit" and "amissa propria forma" led him to considerations very distant to the main topic of the tractatus, which has a philosophical connotations, that are consequent upon adoption of the antic philosophy by the medieval one.
