Název práce: Trestné činy ublížení na zdraví podle § 145, § 146 trestního zákoníku Abstrakt: Tato rigorózní práce je zaměřena na trestné činy ublížení na zdraví podle § 145 a § 146 zákona č. 40/2009 Sb., trestního zákoníku. Trestné činy ublížení na zdraví a těžkého ublížení na zdraví patří mezi nejzávažnější trestné činy proti lidskému zdraví. Cílem této rigorózní práce je komplexní rozbor trestných činů ublížení na zdraví a těžkého ublížení na zdraví, přičemž důraz je kladen zejména na demonstraci základních rozdílů mezi těmito trestnými činy. Rigorózní práce se rovněž zabývá trestným činem ublížení na zdraví z omluvitelné pohnutky, který je trestným činem privilegovaným vůči trestnému činu ublížení na zdraví a těžkého ublížení na zdraví. Další dílčím cílem této rigorózní práce je také krátká exkurze a vymezení odlišností mezi tuzemskou právní úpravou uvedených trestných činů a právní úpravou anglickou, respektive slovenskou. První část rigorózní práce pojednává o vývoji právní úpravy úmyslných ublížení na zdraví v tuzemsku již od doby Velké Moravy až do přijetí současného trestního zákoníku. Zvýšená pozornost je pak věnována nejzásadnějším právním předpisům, ať už pozdější, či novější datace. Druhá část rigorózní práce se zabývá obecnou charakteristikou jednotlivých znaků skutkových podstat... The title of the thesis: Crimes of bodily harm under section § 145 and § 146 of the Criminal Code Abstract: This rigorous thesis focuses on the offences of bodily harm under sections 145 and 146 of Act No. 40/2009 Coll., The Criminal Code. The crimes of bodily harm and grievous bodily harm are classified among the most serious crimes against human health. The aim of this rigorous thesis is a comprehensive analysis of the offences of bodily harm and grievous bodily harm, with particular emphasis on demonstrating the fundamental differences between these offences. This rigorous thesis also deals with the offence of bodily harm for justifiable motive, which is a crime privileged over the offences of bodily harm and grievous bodily harm. The aim of this rigorous thesis is also, among the other things a brief excursion and delineation of the differences between the domestic legislation of the above-mentioned offences and the English and Slovak legislation. The first part of the rigorous thesis deals with the development of the legal framework of intentional bodily harm in the Czech Republic from the time of Great Moravia until the adoption of the current Criminal Code.
