The scope of this thesis is to examine, on the basis of the tools supplied by the language management theory, the selected judgments of the European Court of Justice and consequently to clarify the practical relevance of this theory within the components of the legal discourse (this means the judgments). The main issue presented is, that based on this theory, complicated language problems, which arise in the EU and are based on the discrimination due to language reasons, can be described as well. It will be emphasized, that the micro and the macro level of a language problem really exist and that they influence each other. The analyzed judgments solved the problems of the limitation of the free movement of persons in the EU, whereby this limitation was caused through the language requirements made by the member states and the EU. Previous to the analysis, the theoretical background of this thesis shall be presented: The problem of the language diversity in the EU, the Language Planning and the Theory of Language Management, the functioning of the European Court of Justice incl. the procedure of the preliminary ruling will be introduced. Finally, in the empirical part of the thesis, eight judgments of the European Court of Justice will be introduced and analyzed. After introducing the tools of the Language... Cílem této diplomové práce je pomocí nástrojů teorie jazykového management analyzovat vybrané rozsudky Soudního dvora Evropské Unie a objasnit tak na těchto součástech právního diskursu (tj. rozsudcích) praktickou relevanci této teorie. Především má být poukázáno na skutečnost, že na základě této teorie mohou být popsány i komplikované jazykové problémy, které vznikají v rámci EU a spočívají v diskriminaci z jazykových důvodů. Bude poukázáno na to, že mikro- a makrodimenze jazykového problému skutečně existují a významně se vzájemně ovlivňují. Rozsudky, které mají být analyzovány, se zabývaly problémy spojenými s omezeními volného pohybu osob v rámci EU, přičemž tato omezení byla způsobena jazykovými požadavky kladenými členskými státy i Evropskou unií. Analýze rozsudků bude předcházet teoretická část této práce: Bude představena problematika jazykové rozmanitosti v rámci EU, jazykové plánování i teorie jazykového managementu, fungování Soudního dvora Evropské Unie včetně průběhu řízení o předběžné otázce. V empirické části práce bude představeno a analyzováno osm rozsudků Soudního dvora Evropské unie. Poté na ně budou v rámci syntézy aplikovány nástroje teorie jazykového managementu. Dva ze zpracovávaných rozsudků se týkají volného pohybu pracovníků, tři svobody usazování se a konečně tři procesních práv.
