Určování výše náhrady škody způsobené porušením antimonopolního práva Evropské unie a soukromoprávní vymáhání její náhrady Abstrakt Efektivní hospodářská soutěž je klíčová pro dosažení ekonomické prosperity vnitřního trhu, zlepšování kvality produkce a co nejvyšší zaměstnanosti. Omezení hospodářské soutěže může naopak vést k neefektivní alokaci zdrojů, ztrátě ekonomického blahobytu a ke vzniku škody na straně soutěžitelů i konečných spotřebitelů. Dosažení a dodržování efektivní hospodářské soutěže je proto jedním z hlavních cílů Evropské unie. Toho lze docílit prostředky veřejnoprávního a soukromoprávního vymáhání. Zatímco veřejnoprávní vymáhání má především sankční a odrazovací funkci, soukromoprávní plní především funkci kompenzační. Přes tuto rozdílnost se oba dva typy vzájemně doplňují. Proto se tato práce zabývá vztahem mezi soukromoprávním a veřejnoprávním vymáháním. Evropská unie přijala dne 26. 11. 2014 směrnici č. 2014/104/EU, která má částečně soukromoprávní vymáhání harmonizovat co do uplatňování nároku na náhradu škody způsobené porušením soutěžního práva. Cílem této práce je zanalyzovat klady a zápory této úpravy. Zároveň se práce zabývá srovnáním dvou referenčních transpozičních vnitrostátních úprav, a to zákona č. 262/2017 o náhradě škody v oblasti hospodářské soutěže, v České republice a... The Quantification of Damages caused by breach of the European Union Competition Law and Private Enforcement of its Compensation Abstract Effective competition is key issue for achieving the economic prosperity of the internal market, improving the quality of production and maximizing employment. On the contrary restriction of the competition can lead to inefficient allocation of resources, loss of economic welfare and damages to both competitors and consumers. Achieving and maintaining of the effective competition is therefore one of the main objectives of the European Union. This can be achieved through means of public and private enforcement. While pubic enforcement has, in particular, punitive and deterring function, private enforcement has, in particular, compensatory function. Despite these differences both categories complement each other. That is why this thesis deals with the relationship between private and public enforcement. On 26 November 2014, the European Union adopted Directive 2014/104/EU, which partially harmonises private enforcement in relation to the right to compensation for damages caused by a breach of competition law.
