Smyslem této práce je prozkoumat a zhodnotit právní úpravu postavení politických stran v České republice a její historický vývoj. Práce se zabývá právem stran v úzkém slova smyslu, tedy zejména úpravou na ústavní úrovni a zákonem o politických stranách. Podle Ústavy ČR je náš politický systém založen na soutěži politických stran, přesto nebývá způsobu jejich zakotvení v právu věnována dostatečná pozornost. Text využívá interdisciplinární přístup, zejména propojení právní vědy a politologie. Práce obsahuje celkem sedm kapitol přičemž postupuje od obecného ke konkrétnímu. První kapitola se zabývá pojmem politické strany. Nejprve na něj nahlíží všeobecně prizmatem společenských věd, poté se zabývá politologickými definicemi a nakonec z právního řádu extrahuje definice zákonné a charakterizuje soukromoprávní postavení stran. Druhá kapitola popisuje funkce stran obecně i podle zákona. Třetí kapitola pojednává podrobně o vývoji právního postavení stran od roku 1852 do současnosti. Čtvrtá kapitola rozebírá platný zákon o politických stranách, jeho vznik a novelizace. Pátá kapitola řeší podmínky vzniku stran. Šestá kapitola rozebírá zánik politických stran a konečně sedmá navazuje s analýzou konkrétního případu, rozpuštění Dělnické strany. Napříč kapitolami je pak využívána relevantní judikatura. V závěru... The aim of this thesis is to explore and evaluate legal position of political parties in the Czech Republic and its historical development. This thesis deals with political party law in a narrow sense, particularly with constitutional arrangement and the Political Parties Act. According to the Constitution of the Czech Republic our political system is based on a competition of political parties, despite this fact not enough attention is usually devoted to their position in a legal system. This text uses an interdisciplinary approach combining mainly legal and political science. The thesis contains seven chapters and moves from general to specific. The first chapter deals with the term political party. Firstly it observes it from the prism of social sciences then it moves to political science definitions and in the end it extracts legal definitions and characterizes a private law nature of parties. Second chapter is about functions of political parties both in general and according to the law. The third chapter describes in detail the development of legal position of political parties from the year 1852 to the present time. The fourth chapter analyses current Political Parties Act its creation and amendments. The fifth chapter examines conditions of creating parties. The sixth chapter is about...
