Předmětem této rigorózní práce jsou odklony v trestním řízení vycházející z principů restorativní justice, tj. odklony v tzv. užším smyslu, které jsou spojeny s určitým výchovným působením na osobu obviněného. Práce je mimo úvod a závěr strukturována do čtyř základních částí, přičemž popisu jednotlivých odklonů předchází historický exkurz popisující zločin a trest a vývoj práva a spravedlnosti, resp. následují návrhy de lege ferenda, formulované na základě výsledků realizovaného výzkumu. První část je zaměřena na popis zločinu v lidské společnosti od jejích prvopočátků, kdy počal být vytvářen určitý systém obranných mechanismů (sankcí) určených k její obraně před jednáním narušujícím její fungování a pospolitost. Jsou zde diskutovány absolutní a relativní teorie trestu, resp. odplatná a regulativní funkce trestu, pojem termínu zločin ve vztahu k juristickému a sociologickému pojetí kriminality. Dále tato kapitola přináší úvahu nad pojmy právo a spravedlnost, přičemž nastiňuje marnost hledání absolutní spravedlnosti, na jejímž základě by se jakékoli jednání dalo hodnotit jako spravedlivé či nespravedlivé a vědecký úhel pohledu na kriminalitu, který přináší poznání, že zločin je za určitých okolností schopen spáchat kdokoli z nás. Subject of this rigorous thesis are diversions in the criminal proceedings, stemming from principles of restorative justice, i.e. diversions in a so-called narrow sense of word, which are connected with a certain educational affect on a defendant. Except for the Preamble and Closure, the thesis is structured into four basic parts and description of individual diversions is preceded by a historical excursus describing a crime and sentence, as well as the development of law and justice, eventually proposals of de lege ferenda formulated on the basis of results of the realized research follow. The first part is focused on description of a crime in the human society from the very beginning of its existence when a certain system of defensive mechanisms (sanctions) designed to defend the society against the acting endangering its functioning and commonality started to be created. This part deals with absolute and relative theories of a sentence, i.e. its retributive and regulative function, a concept of a crime in relation to juristic and sociological understanding of criminality.
