Vztah trestního a daňového řízení optikou zásady ne bis in idem Abstrakt Práce reflektuje soudobou judikaturu evropských i tuzemských soudů, která připouští možnost paralelního vedení daňového i trestního řízení o tomtéž skutku téže osoby. Autorka si klade za cíl porovnání obou řízení, analýzu předmětné judikatury a vyhodnocení z ní vyplývajících dopadů na český právní řád z hlediska zásady ne bis in idem. V úvodu je pojednáno o trestním i daňovém řízení a jejich základních rysech a principech, jimiž jsou tato ovládána. Poukázáno je na to, co mají obě řízení společného (důraz je kladen na způsobilost obou řízení podstatnou měrou zasáhnout do základních lidských práv a svobod) i na nejdůležitější odlišnosti mezi nimi (zejména v oblasti dokazování). Následuje kapitola věnovaná daňovým deliktům, a to jak těm, jež jsou upraveny v rovině práva daňového (tzv. delikty proti platební disciplíně a správní pořádkové delikty), tak trestným činům daňovým. Stručně referováno je též o trestním právu daňovém. V dalších částech práce je podán výklad o smyslu, účelu a ukládání trestních sankcí a rovněž charakteristice daňového penále, jehož trestněprávní povaha dovozená judikaturou je pro zkoumanou problematiku stěžejní. Na to navazuje pojednání o samotné maximě ne bis in idem - jejím právním ukotvení, účincích a významu.... Relationship between criminal and tax proceedings from the perspective of the ne bis in idem principle Abstract The thesis reflects upon the current case law of the European and national courts, which enables the possibility of both tax and criminal proceedings for the same act of the same person running simultaneously. The aim of the author is to compare both types of proceedings, analyse the relevant case law, and evaluate the consequences of its conclusions on the Czech legal order in the view of the ne bis in idem principle. The opening describes the criminal and tax proceedings, their main features, and principles governing them. Features common to both types of proceedings are noted (the ability to substantially infringe the human rights of individuals), as well as the most significant difference between them (particularly when the rules of evidence are concerned). The next part of the thesis is devoted to tax delicts, both those governed by the tax law (so called delicts against the remittance discipline and administrative delicts) and the criminal law. Tax criminal law is briefly described as well.
