Trestný čin mučení a jiného nelidského a krutého zacházení Abstrakt Tato diplomová práce pojednává o tom, jak je koncept mučení a jiného krutého, nelidského či ponižujícího zacházení a trestání vnímán optikou mezinárodního, regionálního a v neposlední řadě také vnitrostátního práva a jak jsou tyto jednotlivé systémy vzájemně provázány ve snaze vymýtit fenomém mučení a ostatních forem špatného zacházení z moderní společnosti. V úvodu se poměrně obsáhle zabývám historickými přístupy k mučení a ostatním formám špatného zacházení, a snažím se tak poskytnout komplexnější pohled na danou problematiku a usnadnit pochopení toho, proč jsou mučení a ostatní formy špatného zacházení i v dnešním světě mnohdy předmětem kontroverze. Následující kapitola je věnována právnímu zakotvení zákazu mučení a ostatních forem špatného zacházení na mezinárodní a regionální urovni, včetně toho, jakým způsbem jsou tyto pojmy napříč konkrétnimi dokumenty definovány. Následuje kapitola pojednávající o tom, že zákaz mučení a ostatních forem špatného zacházení je nutno chápat jako součást konceptu základních lidských práv a svobod a rovněž o tom, zdali existují nějaká absolutní a nezrušitelná lidská práva, včetně toho zdali je zákaz mučení a ostatních forem špatného zacházení součástí tohoto systému absolutních a nezrušitelných práv, či... The crime of torture and other inhuman and cruel treatment Abstract This master thesis concerns itself with a concept of torture and other cruel, inhuman or degrading treatment or punishment and how is this concept perceived through the international, regional and last but not least national system of law. Not to mention particular efforts aiming at the eradication of torture and other forms of ill treatment in the context of all the systems of law mentioned above. At the very beginning I am trying to deal with very specific historical approaches towards the torture and other forms of ill treatment themselves. Through this I am trying to provide for more comprehensive view on the given problematics as well as better understanding of why are torture and other forms of ill treatment still subject to controversy. Following chapter is dedicated to legal anchoring of the prohibiton on torture and other forms of ill treatment, especially within the international and regional system of law including particular attempts to define torture and other cruel, inhuman or degrading treatment throughout these systems mentioned above.
