I Resumé Spolkové právo je s účinností od 1. ledna 2014 komplexně upraveno v zákoně č. 89/2012 Sb., občanský zákoník. Vůbec poprvé jsou na našem území zákonem upraveny některé orgány spolku. Cílem této práce je provedení kritické teoretické analýzy platné právní úpravy orgánů spolku. Pozornost je však věnována i praktickým dopadům nové právní úpravy, včetně konsekvencí v oblasti veřejných rejstříků. Práce má celkem osm kapitol, z nichž první se věnuje teoretickým pojetím právnické osoby a odpovídá na otázku, kterou z teorií se nejvíce nechal inspirovat český zákonodárce. Druhá kapitola věnovaná sdružovacímu právu a principu spolkové autonomie zasazuje pojednávané téma do širších ústavněprávních souvislostí. Kapitola třetí je věnována stručnému nástinu právního vývoje spolku, jeho pojmovým znakům a otázce jeho vzniku. Počínaje čtvrtou kapitolou se práce zaměřuje na orgány spolku. Nejprve jsou vymezeny orgány spolku jako takové a provedeno dělení na obligatorní a fakultativní orgány (čtvrtá kapitola). Následně pátá kapitola pojednává o nejvyšším orgánu spolku a šestá o statutárním orgánu spolku. Ve dvou posledně jmenovaných kapitolách jsou rovněž zmíněny některé zajímavosti či odlišnosti v úpravách Španělska, Francie a Itálie. Sedmá kapitola je věnována kontrolnímu orgánu spolku a závěrečná, osmá, kapitola... Since 1st January 2014, association law has been entirely governed by Act No. 89/2012 Coll., Civil Code. It is the first time in history that certain bodies of associations are regulated by law in the Czech legal system. The aim of this theses called "The bodies of association in the Czech law" is to provide critical theoretical analysis of contemporary Czech law regarding the bodies of association. The thesis also focuses on potential practical problems which may arise, including, for example, register of association. The work is divided into eight chapters. The first is dedicated to theoretical approaches of legal persons and provides an answer to the question which theoretical approach influenced Czech lawmakers most. Second chapter deals with the concept of freedom of association and autonomy of associations. This serves to put the main topic into broader constructional context. Third chapter contains brief history of association and analyses conceptual elements of association as well as its establishment. Starting with the fourth chapter, each following chapter is dedicated to particular bodies of association.
