1 Práce se zabývá reklamou na humánní léčivé přípravky a její veřejnoprávní regulací obsaženou v předpisech správního práva. Cílem práce je podat informace o existující právní úpravě v této oblasti, blíže vysvětlit jednotlivé právní instituty, ukázat jejich použití na příkladech z praxe a navrhnout potenciální změny právní úpravy v případech, které autorka považuje za vhodné. První kapitola je věnována úvodu, ve kterém jsou stručně shrnuty cíle práce, její členění a důvody pro výběr předmětného tématu. Druhá kapitola je věnována vymezení základních pojmů léčivý přípravek, reklama, veřejnoprávní regulace a pokyny Státního ústavu pro kontrolu léčiv, jejichž správné chápání je pro porozumění následujícímu textu nezbytné. Třetí kapitola se zabývá regulací reklamy, a to nejprve obecně, a dále konkrétně regulací reklamy na humánní léčivé přípravky, přičemž práce je strukturována tak, že pojednává odděleně o reklamě zaměřené na širokou veřejnost a o reklamě zaměřené na odborníky. Čtvrtá kapitola se věnuje odpovědným subjektům, dozorovým orgánům, správnímu řízení a rozhodování ve správním soudnictví v předmětné oblasti, správním deliktům a sankcím. Pátá kapitola se zabývá popisem dvou konkrétních případů a jejich procesním průběhem před správními orgány i správními soudy, jakož i právními závěry z nich... 1 This thesis deals with advertising of medicinal products for human use and its public law regulation contained in administrative law regulations. The thesis aims to bring information on the existing law in this area, further explanation of particular legal institutes, demonstrate their application in practice and propose potential amendments of the existing regulation in appropriate cases. The first chapter is devoted to introduction and briefly summarizes goals of the thesis, its structure and reasons for choice of the particular theme. The second chapter is devoted to definition of crucial terms of a medicinal product, advertising, public law regulation and instructions of the State Institute for Drug Control, since their correct understanding is necessary for comprehension of the following text. The third chapter concerns regulation of advertising, firstly in general and consequently concretely advertising of medicinal products for human use. The thesis is structured so that it concerns advertising focused on wide public separately from advertising focused on experts.
