Orgány společenství vlastníků jednotek a jejich rozhodování Diplomová práce pojednává o orgánech společenství vlastníků jednotek, jejich postavení v českém právním řádu a jejich rozhodování. Práce je zaměřena na výkon rozhodovací činnosti v praxi a problémy s ní spojené. Zaměřuje se především na právní úpravu zákona č. 72/1994 Sb., zákona o vlastnictví bytů, včetně nařízení vlády č. 371/2004 Sb., jímž se vydávají vzorové stanovy společenství vlastníků jednotek, kde se zaměřuje na problematická ustanovení či chybějící právní úpravu. Diplomová práce se skládá ze čtyř kapitol. Kapitola první je úvodní, jsou zde definovány cíle práce, postavení bytového vlastnictví v českém právním řádu, jeho historický vývoj a vymezení stěžejních pojmů. Druhá kapitola popisuje společenství vlastníků jako právnickou osobu, její vznik, práva a povinnosti, postavení v právním řádu včetně členství, kde se blíže věnuje podmínkám vzniku, právům a povinnostem jednotlivých členů, i zánikem členství. Třetí kapitola pak popisuje orgány společenství vlastníků jednotek. Tato kapitola je rozdělena do tří částí, kdy první z nich popisuje postavení orgánů, především shromáždění a výkonných orgánů společenství vlastníků jednotek, druhá část popisuje jejich ustanovování a volbu a třetí pak jejich rozhodování, kdy se práce zabývá... The governing bodies of the association of owners of (residential) units and their decision/making This thesis deals with the governing bodies of the asscociation of owners of (residential) units, their position in Czech legal order and their decision-making. Thesis is focused on the performance of decision making in practise and problems which are associated with it. It focuses primarily on the enactment of Act No. 72/1994 Coll., Act on ownership of (residential) units, including government regulation No. 371/2004 Coll., where are defined standard Articles of owners of (residential) units, which focuses on the problematic provisions or lack of legislation. The thesis consists of four chapters. The first chapter is introductory, there are defined goals of the work, postition of ownership of units in the Czech legal system, its historical development and definition of key terms. The second chapter describes the association of owners of (residential) units as a legal person, its origin, the rights and obligations standing in the legal system, including membership, which takes a closer view of the conditions, rights and obligations of individual members, and way of termination of membership.
