Modification of community property and third parties rights protection Abstract Community property is one of the fundamental elements of matrimonial law. Currently, the issue of protecting the rights of third parties in connection with the modification of the joint property of spouses, is still growing. That is why I have chosen the issue of modification of the community property and third parties rights protection as a topic of my thesis. The aim of this thesis is to thoroughly analyze and explain the institute of modification of community property, especially with regard to the protection of the rights of third parties. This thesis is divided into eleven chapters. Chapter One defines a concept of joint property by determining its content and listing the ways in which the joint property can be adjusted - legal regime, contractual regime and regime based on court decision. In the following Second chapter, I focus on historical development of the matrimonial property law. The Third chapter refers to the current Czech legislation of joint property of spouses, which is incorporated in the civil code. 1 Summary The legal institute of marriage and connected property relations between the spouses are more than other areas of law influenced by social changes and atmosphere in the society which determine further development and direction of this area of law significant for life. The matter of marital property relations is currently complicated for legal laymen, not only because the public has not got sufficient legal awareness regarding the variety, advantages and disadvantages of individual contractual modifications of marital property relations, which are therefore used very rarely, but often we can also see that the spouses don't even know what is the subject matter of the basic and subsidiary legal marital regime, e.g. community property of spouses, which can have consequently a significant impact on their lives. The aim of the submitted rigorous thesis was to evaluate, whether the current legal regulation of modifications of marital property can stand in comparison with the Spanish legal regulation contained in Código Civil as a codex with long-standing tradition and where could be eventually found inspiration for considerations de lege ferenda. The Master's Thesis deals with the common property of spouses according to both current legal regulation, and secondly future legal regulation of the Czech Republic. The main objective of this Master's Thesis is to present a comprehensive and coherent overview of the current legal regulation of common property of spouses and to compare the present situation with the regulation in new Civil Code, which takes effect in January 2014. The Master's Thesis contains three parts; first part contains the historical development, second part provides a summary of current legal regulation and the last part focuses on the comparison of the current and future legislation.

This thesis deals with the common property of spouses in case of business activities of one of the spouses. First chapter defines marriage and other related issues. Second chapter is the analysis of legal regulations of property relations between spouses since the days of Rome up to the present day, which influenced up-to-date legal regulations. Third chapter deals with the forms of ownership in marriage. Last chapter is about the most important issue of the thesis - common property of spouses and business activities.
