The Principle of Solidarity and Burden-sharing in the EU Area of Freedom, Security and Justice

This thesis deals with the issue of solidarity and burden-sharing (responsibility-sharing respectively) in the EU Area of Freedom, Security and Justice. Its primary aim is to apply the theory of burden-sharing to the case of the EU asylum policy and in particular, to verify or falsify Olson's free-riding hypothesis on the exploitation of the great by the small (meaning of the rich by the poor). This hypothesis will be tested using a mixed research method which combines qualitative and quantitative elements. The qualitative part will focus on the analysis of the so-called Dublin Regulation (Dublin II and III) and its criteria and mechanisms of determining the responsible Member State for examining an asylum application. Applying Moravcsik's liberal intergovernmentalism, a special emphasis will be placed on the proces of negotiating the Regulation (Dublin II) in an attempt to identify and clarify dominant Member States' positions and their influence on the final wording. Consequently, the level of burden- sharing will be illustrated on the example of interstate transfers of asylum seekers (so-called physical burden-sharing). The Limits of the EU's Foreign Policy by Way of an Example of Building Palestinian Statehood

The bachelor thesis "The Limits of the European Union's Foreign Policy by Way of an Example of Building Palestinian Statehood" addresses issues of effective performance of the EU foreign policy during the process of building an independent state of Palestine. The attention is paid to internal and external influences affecting its formation. The text is divided into four parts, the first of which sets out a general concept of foreign policy and concentrates on genesis of cooperation among member states in the sphere of foreign policy. The second chapter analyses internal factors (i.e. institutional mechanisms and attitudes of EU member states) having a limiting impact on an effective performance of the European foreign policy. The third part defines analogously external limits given by the interaction between the EU and other global and regional political actors of the international scene. In the last chapter these limits are demonstrated on the case of the reaction of the international community to the electoral victory of Hamas in the Palestinian parliamentary elections held in January 2006.
