Local referendum in the CR - the law, its application in practice and ideas de lege ferenda

The thesis examines local referendums, a form of direct democracy that is used the most in the Czech Republic. Nowadays, it is a standard part of municipal politics. The goal of the paper is to provide a complex analysis of the legislation, based primarily on relevant case- law, and to provide proposals for its amendment. The thesis is composed of an introduction, ten chapters and a conclusion. The order of the paper largely follows the composition of the Act on Local Referendum. Chapter One describes direct democracy and its forms. Chapter Two examines the relevant constitutional and international legislation. Chapter Three describes the scope of topics that may be subjects of local referendums in general and also looks at the most frequent ones. Chapter Four concerns itself with voters and the preparative committee - a body that puts forward the proposal to hold a local referendum - and examines its assembling and operation. Chapters Five and Six explore the committee's proposal and its review procedure conducted by municipal authorities and also by municipal councils that render the final decision to hold a local referendum. Clinical trials of medical products for human use in the Czech Republic

The issue of legislative and ethical requirements on research of innovative medicines became more intense in connection to the expansion of the pharmaceutical industry in last few decades. This master thesis aims to complexly describe and analyse theoretical bases of current legislative regulating the process of clinical trials of medicinal products for human use in the Czech Republic, as well as to take a closer look to the issue of ethical review administered by specialized ethical review committees. The author also deals with some specific responsibilities of the committees from the perspective of administrative law, especially focusing on aspects of legal nature of the positive opinions, which are one of the conditions for commencement of a clinical trial. The thesis is divided into nine chapters and the introductory chapter is focused on the general outline of the issue of clinical trials of medicines for human use in the Czech Republic. The aim of the second chapter is to define the basic concepts stated in the Czech medicinal products act, which are specific for this area of pharmaceutical law. "Za svobodu" "For freedom" - Czechoslovak coup d'état in 1948 "Za svobodu" "akce Skaut" ("operation Scout") which is considered to be the largest provocatio ("maj. Král" Maj. Size segregated atmospheric aerosol in selected workspaces of coal strip mine

The workers are exposed to aerosol particles in a coal strip mine. These particles are usually generated by the Bucket-wheel excavators which break the mined rock. The goal of the thesis thesis was to compare the concentrations of atmospheric aerosol particles - PM on the Bucket-wheel excavator Schrs 1320, the Stacker ZPDH 6300 and the Bucket- wheel excavator K 800/N2 in the coal quarry Doly Nástup Tušimice, and then to answer the questions what is the main cause of increased concentration PMx and whether the mining machines are different from each other. The measurement was realized stepwise on every mining machine in the time period from 12. 8. to 2. 9. 2016. The concentrations of PM1, PM2,5 and PM10 were measured by two portable laser nephelometers in the cab drivers and the outdoor walkway of the mining machines with the integration time of 1 minute. The air temperature and the relative humidity were monitored in both types of settings in every five minutes. The PMx concentrations variability is usually determined by the type of work and by the type of smoking. Thesis title: Procedure of application for a planning permission This diploma thesis deals with the planning permission proceedings, which is a proceeding to render the planning permission that is one of all instruments of land-use planning. The aim of this thesis is to cover the planning permission proceedings and to outline problematic aspects that are relevant in legal regulations. Beside relevant legal regulations the author results from literature and jurisdiction above all of the Highest Administrative Court of the Czech Republic. In introduction defines basic terms and subsume the topic into legal context and covers the goals and aims of land-use planning, as well as individual conceptual and realization instruments. In second chapter describes individual types of planning permissions and cases, when they are needed and on the contrary, cases, when it is possible to place projects into land without these planning permissions. Role of MAPK in regulation of cytoplasmic polyadenylation during meiotic maturation of mammalian oocytes

Mammalian oocytes undergoing meiotic maturation are transcriptionally silent and gene expression is therefore regulated at the level of translation. One of the well established mechanisms employed in translational regulation of maternal mRNAs in oocytes is cytoplasmic polyadenylation. This process is generally controlled by phosphorylation and activation of cytoplasmic polyadenylation element binding protein (CPEB). The aim of this thesis is to determine the role of mitogen-activated protein kinase (MAPK) in regulation of CPEB-mediated cytoplasmic polyadenylation in maturing mouse and porcine oocytes. For this purpose, MAPK activity was inhibited using its specific inhibitor, GDC-0994 and the effect of MAPK inhibition on cyclin B1 mRNA polyadenylation was monitored. In mouse oocytes, MAPK inhibition impaired neither cyclin B1 mRNA polyadenylation nor its translation and MAPK is thus unlikely to be involved in regulation of cytoplasmic polyadenylation in this species. Based on the results of experiments performed using porcine oocytes, the possible role of MAPK in CPEB-mediated cytoplasmic polyadenylation can neither be confirmed nor ruled out. This master thesis is a description of the clinical trial, which is part of medical law un- der the law aspects. This thesis is split to topic, whose a brief outline is in the introduction. Process of the clinical trial and their institutions are discussed under the law and medical aspects. Resources of this thesis are a professional literature, knowledge of experts from pharmaceutical company and my own experience from part-time job in this type of com- panies. Aim of the thesis is to bring more resources and information about that topic to experts and other people who are interested in. This thesis is devided into five chapters. First chapter is speaking about a general insti- tute in the clinical trial. There are listed sources of the law. In the next chapter I deal with the process of the clinical trial from the begining i.e. from the development of a new sub- stance through the clinical trial to the final registration. Sound and audiovisual recording as means of evidence in administrative proceedings

The aim of the thesis is to answer the questions regarding the subjects authorized to take a sound or audiovisual record, and to assess the legality of using such records as evidence in administrative proceedings. The thesis is formally divided into three chapters. The first one addresses the basic concepts emerging throughout the thesis, and the admissibility of other evidence not expressly mentioned by law. The second part of the thesis offers an insight to obtaining of sound and audiovisual records, and their further use as evidence pursuant to the basic human right documents. It describes and analyses the assessment of permissibility of such evidence that is applied by the European Court of Human Rights. The last chapter works with national legislation of both public and private law, and with the case law of domestic courts; from which it infers the subjects authorized to take these records, which may be used as evidence by an administrative authority. Based on the analysis of legislation and case-law, the thesis defines subjects authorized to obtain a sound or audiovisual record, and sets conditions for such obtaining.
