The protection against illegal inaction of administrative bodies Public authorities are an important part of a system that ensures the implementation of executive power in the country. These bodies in their activities have the means, characteristic for the executive branch. In carrying out its tasks can significantly interfere in the sphere of legal persons. The democratic rule of law, including Czech Republic, must be the performance of public administration has consistently dominated by the principle of legality. The principle of legality, which is the most important principle for the exercise of public authority, the system provides the legal instruments created by the legislature. This is the so-called guarantee of legality. It is important not only to anchor these legal instruments in the legal system, but also their proper functioning. It is not simple, because the best legal mechanism is being implemented and people can not be ruled out of their never misconduct. Závěr Z konkrétních případů, které jsem v práci popsala, dle mého názoru jednoznačně vyplývá problematičnost duálního systému soudního přezkumu správních rozhodnutí. Právě nejasnost rozdělení pravomoci mezi civilní soudy a správní soudy, která správním soudům umožňuje zaujímat názor, že jde o věci soukromoprávní, a civilním soudům názor, že jde o věci veřejnoprávní, vede imanentně k průtahům v řízení, jak je například vidět v případu, který jsem popsala v bodě 5.1. Tam soudní řízení trvalo ode dne podání žaloby k obecnému soudu rozhodujícímu podle občanského soudního řádu do rozhodnutí Zvláštního senátu téměř pět let a po této době byl spor opět zcela na svém počátku. Žalobci, kteří zpravidla musí vždy absolvovat relativně dlouhé správní řízení, pak sice očekávají od soudního přezkumu správního rozhodnutí přiměřeně rychlou ochranu svých práv, ať už jde o subjektivní práva veřejná či soukromá, ale bohužel jim však současný duální systém soudního přezkumu správních rozhodnutí takovou perspektivu nedává. Vlastností tohoto systému je totiž to, že v řadě případů žalobce musí několik let nejprve řešit procesní otázky, místo toho, aby se vedl spor o věci samé. The basement of the thesis consists in the institutional and material view-points, the organization of administrative justice as well as the material aspect. Obtained knowledge is compared with the current model of the administrative justice under the law of the Czech Republic. The main purpose of the thesis is to compare the above- mentioned models of administrative justice and to delimitate subsequently certain identical, similar and different elements.
Position of activities of the Council for Radio and Television Broadcasting

This thesis deals with the issue of The Council for Radio and Television Broadcasting (the Council). The Council is an administrative office, which the public has little information about, and this lack of facts often results in various misunderstandings. The main objective of this thesis is to provide information about the Council and its activities and thus help to eliminate these mistakes and lack of knowledge. The thesis combines the administrative law and the media law. The thesis is composed of two major parts. The Council in general is dealt with in the first part. The history is summarized, the Council as an independent administrative regulatory authority is described and further examples of such administrative offices are provided in this part. The areas in which the Council operates are presented in the second part of this thesis, which is divided into three chapters according the main laws concerning the broadcasting. The first one deals with the law on broadcasting. Key broadcasting licenses and basic obligations of broadcasters are discussed in this chapter. The second chapter is about the law on the regulation of advertising. Review of secondary legislation before the administrative courts

The relationship between constitutional and administrative justice might be defined as very close. In many fields of their jurisdiction, including the judicial review of legal regulations, there is no strict line of demarcation. Contrary to the control of constitutionality of laws that unambiguously belongs to constitutional courts, the judicial review of legal regulations other than laws (secondary legislation) may be under certain circumstances performed also by administrative justice. Pursuant to the Article 87, paragraph 3, letter. a) of the Constitution of the Czech Republic, a law may stipulate that in respect of repeal of legal regulations, which are in violation of the law, rulings shall be issued by the Supreme Administrative Court in place of the Constitutional Court. Notwithstanding the foregoing, such constitutional delegation has not been applied till now and mentioned review of secondary legislation still belongs to constitutional justice. The major objective of this study is to analyse specifics, advantages and imperfections of secondary legislation review performed by administrative courts.
