Status and role of authorized experts in the Czech Legal System

Rigorózní práce se zabývá současnou právní úpravou znalecké činnosti, která platí v České republice v téměř nezměněné podobě již více jak 43 let a vzhledem k současnému společenskému uspořádání ji jistě nelze hodnotit jako nejdokonalejší. Rigorózní práce předkládá výklad platné právní úpravy upravující oblast soudního znalectví, její aplikaci na současnou praxi soudních znalců hlavně v oboru ekonomie a analýzu nejspornějších a nejméně jasných otázek této právní úpravy. Práce se též de lege ferenda zabývá záměry ve světle nově navrhované právní úpravy. Autor tyto záměry shrnuje a hodnotí, přičemž dospívá k závěru, že nová právní úprava by měla být připravena důkladně a promyšleně tak, aby současný nevyhovující stav celkově napravila a ne ho ještě více zhoršila. Abstract The thesis analyses the current Czech legislation on certified experts, which has been in force for more than 43 years, remaining almost unchanged throughout this period. Enforceability of Instruments of Common Foreign and Security Policy of the EU

Povaha SZBP vede k závěru, že poruší-li členské státy své povinnosti v této oblasti, nelze v zásadě v rámci práva EU jejich splnění vynutit a v úvahu přicházejí jen mezinárodněprávní sankce. Tento fakt je dán tím, že nástroje buď nejsou závazné nebo, když jsou, není stanoven postup jejich vynucení. Jedinou výjimkou tvoří hospodářské sankce, jako nástroj s komunitárním prvkem, avšak i zde lze v konečném důsledku možnost vynucení zpochybnit.

Building a predictive model for bankruptcy

Thesis deals with complex process of creation of new bankruptcy model for predicting business failure, while this process involves selection of quality sample, verification of classification accuracy of already existing bankruptcy models, profile analysis and finally the derivation of specific equation of bankruptcy model. The derivation is performed by using two selected statistical methods, discriminant analysis and logistic regression. Two bankruptcy models Bürger's index DA12 and Bürger's index LR12 were derived by using the mentioned statistical methods. The new models distinct advantage is, unlike already existing and renowned bankruptcy models, that they are focused on classification of micro and small enterprises in terms of Czech Republic, while classification accuracy one year before failure is by individual models 74.8 % and 81.87 %. Derived models have clear interpretation (no grey zone) and easy calculation, which brings a possibility for micro and small entrepreneurs to check their business partners in terms of failure prediction.

Evaluation of yield and risk of investment while depositing available financial resources of the company

There are evaluated possibilities in my thesis which the company with enough available financial resources has while investing at commodity markets into the gold, silver and platinum. The thesis briefly describes functions and regulation of exchange including the description of instruments the company can use for investment. Another part of my work is a description of statistical evaluation of price data of commodities. Statistical methods and formulas are also analysed in methodology. Practical part contains evaluation of price development which is also described by means of various mathematical curves. Finale of my work is discovery if and for how long it was worth to invest into gold in years 2000 - 2011. My mental hypothesis that more years investment mean higher year yield rate was disproved. The result says that the long-term investment (12 years) had the lowest year yield rate.
