Vondráková, Renáta ; Balon, Jan (advisor) ; Petrusek, Miloslav (referee)
Diplomová práce Spor o pozitivismus v německé sociologii. Renáta Vondráková. 2012. Abstract The main theme of the work is the issue of positivism dispute, which is commonly referred to discussions that occurred in German sociology in the sixties. It was a debate between advocates of critical theory, which were Theodor W. Adorno and Jürgen Habermas, and the concept of critical rationalism of Karl R. Popper and Hans Albert. The discussion initially was confined to issues related to the logic of the social sciences, for many reasons, but rather applied to differences between the concepts and challenges of science from the perspective of both the above approaches. Also the description and discovery purposes and contexts that led to the overturning topic discussion are devoted to this work. The aim is to describe the external influences as widely as possible and how it affected the final understanding of the dispute, but also how well the positivism dispute turned the concepts of science in the following period. The first part is concerned with social and historical situation in which the dispute arose. Followed by an outline of key terms that in connection with a dispute likely occur, in fact it is the analysis of major issues. Emphasis is placed on a thorough description of the first two contributions to the...

The medieval settlement in East Bohemia

Procedural legal aspects of dispute resolution in international economic law
Jakabová, Katarina ; Balaš, Vladimír (advisor) ; Šturma, Pavel (referee)
Katarína Jakabová Abstract ABSTRACT Procedural aspects of the dispute settlement in international economic law The dispute settlement in the international economic law of nowadays takes place under more institutionalized mechanism as in the past half-century. The aim is clear: better enforceability of the law (of the award) based on the fast and efficient "under one roof" procedure. This thesis focuses on the procedural aspects of the dispute settlement within the World Trade Organization (WTO), the International Centre for Settlement of Investment Disputes (ICSID) and the North American Free Trade Agreement (NAFTA). Each of these three organizations has its own special dispute settlement procedure, which is above all distinctive from the international trade law by having at least one (member) state as a party to a dispute. I have chosen WTO because it regulates the disputes on a state-state level arising from all the WTO agreements between all WTO members, which makes it the biggest (and very effective, let's admit) dispute settling platform worldwide. ICSID is the first and most popular mixed arbitration allowing a non-state party (an investor) to be a party to a dispute. And finally, NAFTA, even if it is on a substantial level complementing the WTO agreements, represents their competitive version on the...

Cornerová Zdráhalová, Lenka ; Smolík, Petr (referee) ; Tichý, Luboš (advisor)
137 Resumé Mediation in the Context of Modern Europe Keywords: - mediation - Directive 2008 certain aspects of mediation in civil and commercial matters - snapshot of mediation-related legislation in Europe - mediation as an alternative dispute resolution method vs. obligatory pre-trial procedure The purpose of this thesis is to provide an overview of initiatives undertaken over the last decades by international organisations (chapters 1.1 and 1.2) and the European Communities (chapter 1.3) in the area of alternative dispute resolution methods, with special focus on mediation, defined as a process whereby two or more parties to a dispute attempt by themselves, on a voluntary basis, to reach an amicable agreement on the settlement of their dispute with the assistance of a mediator. The thesis (mainly chapter 1.3) looks into the initiatives and processes within the EC that led to the adoption of Directive 2008 May 2008 on certain aspects of mediation in civil and commercial matters, considered a groundbreaking piece of legislation, destined to shape the mediation-related national legislations across the terrotory of the European Union and accelerate the full integration of mediation into the legal systems of individual EU Member States. A separate section of the thesis (chapter 2) provides a snapshot of...
