Implementation of the Third energy package into the legal order of the Czech Republic

Implementation of the Third energy package into the legal order of the Czech Republic Summary This thesis discusses the implementation issue of the Third energy package, also known as the Third liberalization package, into the Czech national law. It consists of three regulations and two directives of the European Union, which determines the energy politics both on the European level and on the level of the member states. The first part of this thesis describes the ancestors of the Third energy package and their accomplishments or failures together with reasons for creating the next generations of liberalizing legislation. The author describes the liberalization in the form of the legal, functional and accounting unbundling separately for electricity and gas industry at the European level, and then the implementation at the level of the Czech legislation. In the next chapter it is further explained, what were the European legislator's incentives for creating the Third energy package, and what new institutes it stipulates. It is herein described that the European Union came with three different unbundling versions of the transmission system operators (TSO) - Ownership unbundling (OU), Independent system operator (ISO) and the Independent transmission operator (ITO). Analysis of the Natural Gas Market during the Period of Deregulation - A Comparison of Selected European Countries

The liberalization of gas markets is in the European Union and especially in its new Member States a current topic. This thesis is devoted to a comparison of the liberalization processes in three Central European countries - the Czech Republic, Slovakia and Poland. The thesis first introduces the concepts of public and natural monopolies, the specific characteristics of gas markets and the legislation of the European Union that underlies the liberalization. Further, the thesis takes a close look at the developments in the gas markets of the three countries. The focus lies mainly on the national legislation, opening of demand side and changes in the market structure, including unbundling, new entrants and supplier switching. The final chapter of the thesis analyzes and compares the progress in liberalization of the individual markets by calculating the market concentrations using the Herfindahl-Hirschman index.

Natural monopolies in Electricity and Gas Sectors (the legal aspects)

The purpose of this diploma thesis is to use relevant economic knowledge for the analysis of the key legal aspects of the natural monopoly, particularly the main theoretical aspects thereto. The interpretation is not limited to principle features, however, it covers also the related issues. The text is focused mainly on electricity and gas industries. Apart from applicable law and legal books, the relevant case law of the Constitutional Court and Supreme Administrative Court of Czech Republic has been also a significant source of knowledge hereto. The European Union legal regulations and expert opinions of the European Commission have been taken into account as well. The diploma thesis is divided into five chapters. The first chapter is focused on economic aspects of the applicable law. It provides thorough overview concerning the model and its introduction into reviewed fields. The principal information, historical background and view of the critics are introduced. This chapter also labels the entities under the Czech law that are considered to be the natural monopolies. The "Unbundling" issue in the center of European debates: its concept and impact on liberalisation of the gas market

Since long the energy policy has been escaping the concept of the common European policies or has been only partially influenced through the harmonisation of other common policies. If energy sector was considered an exclusive competence of every State Member (or as a part of its national security), nowadays, it has made a big step forward. At present, we talk about the establishment of a competitive internal energy market. The energy policy became part of the Community law only after the adoption of the Lisbon Treaty when the sector was granted a separate chapter and henceforth decided upon through a co-decisional procedure. The energy markets were subsequently given a new liberalisation impetus by the approval of the 3rd energy package (July 2009). My thesis focuses entirely on the natural gas sector and its crucial amendment to the network sector regulations. The core subject of the Directive 2009/73/EC concerning common rules for the internal market in natural gas is the ownership unbundling regime which stipulates the separation of production and sale operations from their transmission networks. Klára Vaculíková March 2011 The purpose of the thesis was legal analysis of the power trading in the today's global world. This entails mainly the discipline of international private law. Power trading, in particular transactions on sale and purchase of electric power with an international element are subject to general rules of international private law. Nevertheless, the exceptional nature of electric power and of its disposition described in the thesis makes the area of power trading quite special sub-discipline of international private law. In the same time, very complex and significantly relevant part of the power trading, which the study cannot avoid to consider, is the regulatory framework, within which this specific sort of business is carried on. Legal aspects of network industries and natural monopolies

1 Summary Key words: Natural monopoly, network industry, energy industry, regulation, liberalization, unbundling, third party access The present thesis sets out to explore the legal aspects of network industries and natural monopolies. It researches these aspects using the example of the energy sector (i.e. the power and gas industries), which is a typical example of a network industry. In terms of its geographical scope, the thesis focuses on the EU energy law and its specific application in the Czech Republic. The fundamental point of departure for the present thesis is a believe that energy law is closely intertwined with economic policy, and is appropriately interpreted only in the context of the concrete measures, tools, and concepts meant to reflect a nation's energy policy. The main driver of energy policy, and hence also of energy law, is a reform of the energy industry aiming at its liberalization. The key tools for its successful implementation are economic regulation, third party access, unbundling, and public administration by independent regulatory bodies.
