Circumstances excluding illegality and the types of punishment

The target of this bachelor thesis is to provide basic information about the circumstances excluding illegality and define the various types of punishment. The first part is devoted to detailed description of the circumstances excluding illegality of the past amend the criminal law. This is particularly the utmost necessity, needful defense, consent of the victim, the risk acceptable and allowed handling of weapons. Attention is paid to cases not covered explicitly in the Penal Code, known as the exercise of rights and obligations. The second part focuses on the types of punishment and their characteristics, in many cases supported by practical example. At the conclusion there are set of statistics for demonstration of crimes committed in the Czech Republic for a period of time.

Comparison of Civil and Common law in the area of chosen criminal offences

This bachelor thesis deals with the comparison of Criminal law of two dominant legal systems. The goal of this thesis is to disclose a difference between criminal rules of law of Civil and Common law. At the beginning there is an adumbration of historical evolution of both legal systems and also reasons, why both systems evolved differently. Afterwards individual diversities of both legal systems are mentioned, mainly in the area of criminal law. Next part of the thesis is devoted to recent criminal regulations. With regard to its extensiveness, this bachelor thesis deals only with Czech and English criminal law. It also deals with the structure of division of criminal offence and solves the question, whether it is better to codify the criminal law or not. Last part of this thesis is to compare the criminal offences. This part contains six criminal offences, which interfere with many areas of human life, including murder, fraud or blackmail.

The insurance fraud issue in the Czech Republic

The thesis is being concerned with one of the serious criminal acts causing each year damages worth hundrends of millions Czech crowns. The main aim of the thesis is to provide a complex view of the problems. The thesis analyses the issue from both legal and economic angle of view, deals with the insurance fraud typology and proves the theory by evidence of particular cases. The thesis thereinafter discovers causations of commiting insurance frauds and describes the insurence fraud abatment. In the end the thesis tries to disclose the weak points of the system of prevention, to point at them and to come up with the improvement suggestions and recommendations.
