The protection for pregnant employees from termination of employment

This thesis provides an analysis and comparison of the EU and national legislation concerning protection for pregnant employees from termination of employment. The main goal of this thesis is comparison of the legal protection based on the Council Directive 92/85/EHS and other legal elements incorporated in the Act no. 262/2006 Labour Code. Pregnant woman is in very specific position in terms of employment relations, and she is considered to be a weaker party. Nevertheless, regular employee is also considered to be a weaker party, but in comparison of the legal protection between employee and pregnant employee, we will unambiguously conclude, that level of protection is considerably higher for the pregnant employee then for the regular one. And it is for a legitimate reason since a pregnant employee, during pregnancy and maternity, is endangered not only from the physiology perspective but also from social security perspective. For this reason, the legal acts concerning position of the pregnant employee, in the national or European level, are mostly in their favour. The position of a pregnant woman in employment relations

Pregnancy is significantly protected in labour law and the position of a pregnant woman in employment relations is, therefore, very specific. After the creation of an employment relationship, or a legal relation based on the agreements to work outside the scope of employment, a whole range of protective institutes are in place to ensure a special position of a pregnant worker that is of key importance. The thesis focuses primarily on the position of a pregnant woman during the employment relationship as only there all the protective institutes are present. The introductory parts deal with the reason and importance of the protection of a pregnant worker, its establishment in the Czech legal order and the importance of informing the employer of one's pregnancy. The following parts are dedicated mainly to individual labour law institutes constituting special protection and special working conditions of a pregnant worker during the employment relationship until the commencement of her maternity leave. The last part underlines the differences in the protection of a pregnant woman granted during one of the legal relations based on the agreements to work outside the scope of employment compared to the one granted during the employment relationship. Protection of pregnant women, maternity and parenthood in labour law

The aim of the bachelor thesis is to examine the extent of the legal protection that is provided to pregnant women, women on maternity leave, and parents on parental leave, to evaluate the granted protection in terms of flexicurity and to suggest possible solutions. Firstly, it is focused on the general principles of labour law related with the topic and the relationship between labour law and civil law. In the descriptive part, the thesis deals with the basic legal aspects of the protection of pregnant women,maternity and parenthood. The aspects will be evaluated in terms of flexicurity. Furthermore, the most problematic sections of the law, especially the issue of employment of pregnant women, the onset parents back to work, and opportunities to work during the maternity and parental leave will be analyzed. In conclusion, the current state will be evaluated as well as the possible points of improvements and the description of suitable flexible forms of work will be possessed.
